Առուշ Առուշանյանի բողոքն ընդդեմ ՀՀ արդարադատության նախարարության Պրոբացիայի ծառայության՝ մերժվել է

Գորիս համայնքի ղեկավար Առուշ Առուշանյանի բողոքն ընդդեմ ՀՀ արդարադատության նախարարության Պրոբացիայի ծառայության՝ մերժվել է։ Տեղեկությունը Sputnik Արմենիային հայտնեցին ՀՀ արդարադատության նախարարության մամուլի ծառայությունից։
«Սյունիքի մարզի ընդհանուր իրավասության դատարանի դատավոր Գոռ Գասպարյանը օգոստոսի 27-ին գրավոր ընթացակարգով քննելով Գորիս համայնքի ղեկավար Առուշ Առուշանյանի բողոքն ընդդեմ ՀՀ արդարադատության նախարարության պրոբացիայի ծառայության՝ մերժել է այն»,–հայտնեցին նախարարությունից։
Նշենք, որ Առուշ Առուշանյանը դիմել էր դատարան՝ բողոքարկելով, որ պրոբացիայի ծառայության գործողությունները իրավաչափ չեն։
Հիշեցնենք, որ պրոբացիայի ծառայությունը դիմել էր Գորիս համայնքի ավագանուն՝ տեղեկացնելով, որ համայնքի ղեկավարը պետք է պաշտոնանկ արվի։ Ավագանու նիստի մասնակից 14 անդամները միաձայն արձանագրել են, որ գրության պահանջն ավագանու գործառույթներից դուրս է, առկա է այդ գործընթացը ավագանու կողմից կազմակերպելու անհնարինության վիճակ։
Գորիսի համայնքի ղեկավար Առուշ Առուշանյանը մեղադրվում է պաշտոնեական դիրքի չարաշահման, ինքնիրավչության, ինչպես նաեւ դիտավորությամբ այլ մարդու առողջությանը վնաս պատճառելու մեջ։ Դատական ակտը մտել է ուժի մեջ, բայց Առուշանյանը չի կատարում կետերից մեկը՝ հրաժարվել համայնքի ղեկավարի պետի պաշտոնից։ Ըստ դատավճռի՝ նա չի կարող 5 տարի պաշտոն զբաղեցնել։
Իր հերթին պրոբացիայի ծառայությունը դիմել է դատարան՝ Առուշ Առուշանյանի պատիժը ազատազրկմամբ փոխարինելու հայցով։ Գործը Սյունիքի մարզի ընդհանուր իրավասության դատարանի դատավոր Վարսենիկ Մելքոնյանի վարույթում է։ Նիստը նշանակված է սեպտեմբերի 3-ին։
