«Արմավիր» ՔԿՀ-ում uպանություն է տեղի ունեցել

Դատախազը 2024 թվականի օգոստոսի 30-ին դատարան է հանձնել Արդարադատության նախարարության «Արմավիր» քրեակատարողական հիմնարկի անվտանգության ապահովման բաժնի պաշտոնատար անձանց կողմից իրենց ծառայողական պարտականությունները ոչ պատշաճ կատարելու վերաբերյալ քրեական վարույթով մեղադրական եզրակացությունը և վարույթի նյութերը:
Քրեական վարույթի նախաքննությամբ պարզվել է, որ «Արմավիր» քրեակատարողական հիմնարկի անվտանգության ապահովման բաժնի պաշտոնատար անձինք ոչ պատշաճ հսկողություն են իրականացրել քրեակատարողական հիմնարկի խցում պահվող անձանց նկատմամբ. արդյունքում չի բացահայտվել քրեակատարողական հիմնարկում պահվող անձի՝ խցակցի կողմից պարբերաբար բռնության ենթարկվելու դեպքը, ինչի հետևանքով 2022 թվականի հոկտեմբերի 13-ին «Արմավիր» քրեակատարողական հիմնարկի խցերից մեկում հայտնաբերվել է կալանավորված անձ Ա.Յ.-ի դին: Քրեական վարույթի նախաքննությամբ պարզվել է, որ Ա.Յ.-ի հետ նույն խցում պահվող Ա.Հ.-ն պարբերաբար դիտավորությամբ հարվածներ է հասցրել նրան՝ պատճառելով Ա.Յ.-ի կյանքի համար վտանգավոր այնպիսի մարմնական վնասվածքներ, որոնք հանգեցրել են վերջինիս մահվան (Ա.Հ.-ի վերաբերյալ քրեական գործը՝ սպանության, առողջությանը ծանր վնաս պատճառելու, ֆիզիկական ուժեղ ցավ կամ հոգեկան ուժեղ տառապանք պատճառելու մեղադրանքով, 2023 թվականի դեկտեմբերի 22-ին ուղարկվել է դատարան):
Պարզվել է նաև, որ 2022 թվականի հոկտեմբերի 13-ին «Արմավիր» քրեակատարողական հիմնարկի մասնաշենքի պահակետի շուրջօրյա հերթափոխում ընդգրկված անվտանգության ապահովման բաժնի երեք աշխատակիցները՝ Ա.Խ.-ն, Խ.Խ.-ն և Մ.Զ.-ն, պարտավոր լինելով ի թիվս այլնի իրականացնել խցերում պահվող անձանց վարքագծի նկատմամբ հսկողություն՝ առանձնակի ուշադրություն դարձնելով կալանավորված անձանց կամ դատապարտյալների կասկածելի վարքագծի նկատմամբ, ինչպես նաև սպանության կամ անձի առողջությանը ծանր վնաս հասցնելու նախանշաններ հայտնաբերելիս հայտարարել երրորդ աստիճանի տագնապ և այդ մասին զեկուցել մասնաշենքի ավագին, պատշաճ չեն կատարել իրենց ծառայողական պարտականությունները, ինչի արդյունքում անզգուշությամբ առաջացրել են կալանավորված անձի՝ Ա.Յ.-ի մահը (դիակի դատաբժշկական փորձաքննության եզրակացության, ինչպես նաև դատաբժշկական փորձագետի ցուցմունքի համաձայն՝ Ա.Յ.-ի մահվան հետ ուղղակի պատճառական կապի մեջ գտնվող մարմնական վնասվածքները պատճառվել են նրա կենդանության օրոք և ունեցել են մահվանից րոպեների և ժամերի վաղեմություն):
