«Փակ դռների հետևում ստվերային արդարադատությունը» անթույլատրելի է: Այս մասին հայտարարություն է տարածել Դավիթ Հարությունյանի փաստաբանական խումբը:
«Հարգելի գործընկերներ, մամուլի ներկայացուցիչներ,
Հաշվի առնելով ձեր հարցերը՝ տեղեկացնում ենք, որ Դավիթ Հարությունյանի՝ Սահմանադրական դատարանի որոշման հիման վրա ներկայացրած վերանայման դիմումի քննությունը Բարձրագույն դատական խորհրդում (ԲԴԽ) սեպտեմբերի 17-ին իրականացվել է դռնփակ նիստով: Գործի նյութերին ծանոթանալու հնարավորություն տրվել է միայն նիստից 48 ժամ անց՝ բազմաթիվ դիմումներ ներկայացնելուց հետո:
Սեպտեմբերի 17-ի նիստի արձանագրումներից հայտնաբերել ենք, որ ԲԴԽ-ն նշել է հետևյալը. «Սահմանադրական դատարանի դիրքորոշման հաշվառմամբ, կարևորելով կարգապահական վարույթների քննության հրապարակայնության ապահովվումը և Սահմանադրական դատարանի կողմից որոշմամբ մատնանշված «ստվերային արդարադատության» կայացման մասին հանրային ընկալումների սերմանումը կանխելու անհրաժեշտությամբ պայմանավորված, միաժամանակ հաշվի առնելով Դիմողի՝ արդեն իսկ դատավորի կարգավիճակ չունենալու հանգամանքը, 2023 թվականի հունիս-հուլիս ամիսների ընթացքում Բարձրագույն դատական խորհրդում Դիմողի նկատմամբ կարգապահական պատասխանատվության ենթարկելու հարցի քննության վերաբերյալ գործը հրապարակայնացնելու արգելք այլևս գոյություն չունի»:
Չնայած այս արձանագրությանը, մեր բոլոր միջնորդությունները, այդ թվում՝ Դավիթ Հարությունյանի և լրատվամիջոցների ներկայությունը նիստում թույլատրելու վերաբերյալ, մերժվել են, և գործի քննությունը շարունակում է իրականացվել գրավոր ընթացակարգով:
Այս իրավիճակը հատկապես ուշագրավ է, եթե հաշվի առնենք, որ ԲԴԽ նախագահ Կարեն Անդրեասյանը նախորդ նիստում և Ազգային ժողովի ամբիոնից այս գործը բնորոշել է որպես «երկրի համար կարևորագույն գործ» և նույնիսկ ուրախություն հայտնել Սահմանադրական դատարանի որոշման կապակցությամբ: Ակնհայտ է, որ հայտարարություններն ու իրական գործողությունները հակասում են միմյանց:
Մինչ ԲԴԽ-ն հայտարարում է, որ փորձում է վերացնել Սահմանադրական դատարանի արձանագրած խախտումները և ապահովել գործի հրապարակայնությունը, գործնականում դատավարությունը շարունակում է մնալ դռնփակ և գրավոր՝ խոչընդոտելով թե՛ հանրությանը, թե՛ կողմերին նիստին ներկա գտնվելու հնարավորությունից:
Փաստացի, խախտումները վերացնելու փոխարեն դրանք պարզապես արձանագրվում են հայտարարություններով, ինչը ակնհայտորեն հակասում է Սահմանադրական դատարանի որոշման իրական պահանջներին և վկայում է այն կատարելու ցանկության բացակայության մասին:
Մինչ հաջորդ նիստը, որը նշանակված է հոկտեմբերի 7-ին՝ ժամը 11:00-ին, մենք կշարունակենք պնդել, որ կողմերին և լրագրողներին պետք է տրվի դատական նիստին ներկա գտնվելու իրավունք՝ կանխելու «ստվերային արդարադատության» հերթական իրականացումը։
