ՀայաՔվե» նախաձեռնության խորհրդի հայտարարությունը Հայաստանի և Ադրբեջանի սահմանազատման հանձնաժողովների համատեղ գործունեության կանոնակարգի շուրջ

Հայաստանի Հանրապետության և Ադրբեջանի միջև սահմանազատման գործընթաց իրականացնելը երկկողմ դիվանագիտական հարաբերությունների բացակայության պայմաններում անընդունելի է, քանի որ այդպիսով կտրուկ աճում է սահմանազատման գործընթացում Ադրբեջանի ագրեսիվ գործողությունների հնարավորությունը։
Դիվանագիտական հարաբերությունների հաստատումն իր հերթին հնարավոր է երկկողմ հարաբերությունների օրակարգի կարևորագույն հիմնախնդիրները, առաջին հերթին` արցախյան հարցը համապարփակ հասցեագրելու պարագայում։

Անկախ պետությունների համագործակցություն ստեղծելու վերաբերյալ Ալմա-Աթայի 1991թ․ հռչակագիրը, որին հղում է կատարվում կանոնակարգում, ևս որևէ կերպ չի կարելի մեկնաբանել որպես հրաժարում Արցախի ինքնորոշման իրավունքի իրացումից։ Անընդունելի է նաև այդ հռչակագիրը որպես Հայաստանի և Ադրբեջանի միջև պետական սահմանի սահմանազատման գործընթացի հիմք համարելը, այն պայմաններում, երբ նրան կցված որևէ քարտեզ չկա։

Ի հավելումն, կանոնակարգի նախաբանում արված վերապահումը, համաձայն որի` Ալմա-Աթայի հռչակագրից զատ հնարավոր է համարվում սահմանազատման և սահմանագծման գործընթացի այլ հիմնարար սկզբունք որդեգրելը, ևս հղի է Ադրբեջանի կողմից Հայաստանին տարածքային նոր պահանջներ ներկայացնելու վտանգով, ինչի նախանշաններն արդեն իսկ տեսանելի են։

Կանոնակարգում տեղ գտած հատվածական սահմանազատման գաղափարը ևս կոչված է սպասարկելու ադրբեջանական շահը, քանի որ, ինչպես ցույց է տալիս անցած ամիսներին Տավուշի մարզի սահմանում անցկացված հատվածական «սահմանազատման» ապօրինի դեպքը, դրանից միայն Ադրբեջանն է շահում՝ միակողմանիորեն բարելավելով իր դիրքերը և միևնույն ժամանակ հետ չքաշելով իր զինված ուժերը Հայաստանի Հանրապետության օկուպացված տարածքներից։
Նման հատվածական և ապօրինի սահմանազատման հետևանքով փաստացի արդեն տեղի է ունեցել ՀՀ տարածքի փոփոխություն և յուրացում Ադրբեջանի կողմից, որը, ՀՀ սահմանադրության 89-րդ հոդվածի համաձայն, հնարավոր էր միայն ՀՀ քաղաքացիների կոլեկտիվ կամարտահայտության՝ հանրաքվեի արդյունքում, և չկա որևէ երաշխիք, որ ապագայում ուժի այս կանոնակարգը չի ծառայի նույն հակասահմանադրական նպատակին։

Հաշվի առնելով վերոգրյալը՝ համարում ենք, որ Հայաստանի և Ադրբեջանի միջև դիվանագիտական հարաբերությունների բացակայության և Արցախի հարցի` որևէ կերպ հասցեագրված չլինելու պայմաններում, հայ-ադրբեջանական սահմանազատման հանձնաժողովների գործունեության կանոնակարգ հաստատելը հակասում է Հայաստանի Սահմանադրությանն ու Անկախության հռչակագրին, և հայ ժողովրդի ազգային-պետական շահերին։

Պահանջում ենք ՀՀ Սահմանադրական դատարանից՝ հավատարիմ մնալ ՀՀ Սահմանադրության տառին և ոգուն, և մերժել նշված կանոնակարգի հաստատումը։
