ՆԳՆ և ԱԱԾ հայտարարությունները ընդդիմության հավաքի մասին հակասում են ՀՀ պարտավորություններին

Քաղաքական իրավունքների հայկական կենտրոնը և Հայաստանի հելսինկյան կոմիտեն տարածել են համատեղ հայտարարություն են տարածել՝ ՀՀ ԱԱԾ և ՆԳՆ ոստիկանության կողմից ընդդիմության սպասվող հանրահավաքի վերաբերյալ արձագանքի մասին։
Հայտարարությունում ասվում է. «Այսօր՝ հոկտեմբերի 2-ին, Հանրապետության հրապարակում ընդդիմության նախաձեռնած հանրահավաքին ընդառաջ ՀՀ Ազգային անվտանգության ծառայությունը և Ներքին գործերի նախարարությունը հայտարարություններ են տարածել, որով կասկածի տակ են դրել գալիք հավաքի խաղաղ բնույթը, առանց որևէ հիմնավորում ներկայացնելու։
Եթե ՆԳՆ ոստիկանության հայտարարությամբ հավաքի մասնակիցներին և կազմակերպիչներին կոչ է արվում «ձեռնպահ մնալ հասարակական կարգի խախտումներից», ապա ԱԱԾ հայտարարությամբ ներկայացվում է ծանր հանցագործությունների մի ամբողջ «ցանկից» զերծ մնալու հորդոր՝
«զերծ մնալ իշխանությունը զավթելու, սահմանադրական կարգը բռնի տապալելու, անձի կամ անձանց խմբի նկատմամբ որևէ հանգամանքով պայմանավորված բռնություն գործադրելու, իշխանության ներկայացուցչին դիմադրություն ցույց տալու հրապարակային կոչեր հնչեցնելուց կամ դրանց կատարմանն ուղղված գործողություններ ձեռնարկելուց՝ նախազգուշացնելով, որ տիրապետում է օպերատիվ իրավիճակին, և իրեն վերապահված ողջ գործիքակազմի կիրառմամբ ի զորու է չեզոքացնել ՀՀ ներքին անվտանգության խաթարմանն ուղղված գործողությունները»:
Ուժային կառույցների կողմից առանց հիմնավորման նման հայտարարություններ անելը խախտում է պետության առաջնային պարտականությունը՝ աջակցել խաղաղ հավաքների ազատությանը և պաշտպանել այն։
Պետությունը պետք է ելնի այն կանխավարկածից, որ հավաքների կազմակերպիչների և մասնակիցների նպատակները խաղաղ են, եթե առկա չեն բռնության գործադրման կամ հրահրման համոզիչ ապացույցներ[5]։ Նման որևէ ապացույց կամ հիմնավորում ուժային կառույցները չեն ներկայացրել։ Այլապես, նման ծանր հանցագործությունների նախապատրաստման պարագաներում գործի կդրվեին ուժային կառույցների ողջ ռեսուրսները։
ՆԳՆ և, առավել ևս, ԱԱԾ հայտարարությունները հակասում են խաղաղ հավաքների ազատության իրավունքի ոլորտում պետության ստանձնած պարտավորություններին։ Ըստ այդմ՝ այս հայտարարությունների տարածման միակ դրդապատճառը ընդդիմադիր ուղղվածության հավաքների վարկաբեկումն է։
