Ադրբեջանն ընդդեմ Հայաստանի 2 միջպետական հայց է ներկայացրել արբիտրաժային դատարան

Ադրբեջանն ընդդեմ Հայաստանի 2 միջպետական արբիտրաժային հայց է ներկայացրել Հաագայի մշտական արբիտրաժային դատարան: Sputnik Արմենիային այս մասին հայտնել է միջազգային արբիտրաժի փորձագետ Սարգիս Գրիգորյանը։
«Տվյալ գործերի շրջանակներում արդեն նշանակվել են արբիտրաժային տրիբունալներ։ Այսինքն` կողմերը նշանակել են իրենց արբիտորներին, ունեն նախագահող։ Երկու գործերով առաջին նիստերն արդեն տեղի են ունեցել։ Երկու գործերով էլ տրիբունալներն ընդունել են ընթացակարգերը, արբիտրաժային կանոնները` ինչպես է գործը ընթանալու, ինչպես են քննվելու վարույթները, ապացույցները, ինչպես են ներկայացվելու վկաների ցուցմունքները, փորձագետների եզրակացությունները և այլն։ Երկու գործերը ներկայում ընթանում են»,– հայտնել է մեր զրուցակիցը` հավելելով, որ ըստ հաստատված ժամանակացույցի` գործերը պետք է ավարտվեն 2027թ–ի սկզբում։
Հայցադիմումները, Սարգիս Գրիգորյանի խոսքով, դեռ գաղտնազերծված չեն։ Հայաստանը դրանց վերաբերյալ հրապարակային հայտարարություն չի արել։ Մինչդեռ Ադրբեջանը տարբեր առիթներով արդեն մի քանի պաշտոնական հայտարարություն է տարածել` նշելով, որ նպատակ ունի ՀՀ–ին պատասխանատվության ենթարկել ԼՂ–ում շրջակա միջավայրի և կենսաբազմազաության ոչնչացման համար։
Գրիգորյանի խոսքով` առաջին հայցը, որը ներկայացվել է 2023թ–ի հունվարին Վայրի բնության և բնական միջավայրի պահպանման մասին Բեռնի կոնվենցիայի շրջանակներում է։
«Սա, իհարկե, անհեթեթություն է։ Բայց Ադրբեջանը նաև հայտարարել է, որ 2020թ–ի պատերազմից հետո շրջակա միջավայրի ոչնչացման ապացույցներ է հավաքել։ Այսինքն, ըստ էության հայտարարել է, որ իր միջպետական հայցը հիմնված է 2020թ–ի պատերազմից հետո ձեռք բերված ապացույցների վրա»,– նշում է Գրիգորյանը` հավելելով, որ այս համատեքստում ՀՀ–ի պաշտպանության գործիքներից մեկը պետք է լինի այն փաստը, որ հենց Ադրբեջանն է շրջակա միջավայրին վնաս հասցրել ` պատերազմի արդյունքում ոնչացնելով բնությունը։ Բայց սա առայժմ զուտ մասնագիտական կարծիք է, քանի որ Ադրբեջանի հայցի վերաբերյալ ՀՀ–ի պաշտոնական դիրքորոշումը դեռ հայտնի չէ։
Գրիգորյանի տեղեկություններով` Ադրբեջանը որպես ապացույց մեջբերել է նաև ՄԱԿ–ի 2022թ–ի զեկույցը` ցույց տալու` իբր Հայաստանը անտառահատումներ է իրականացրել։
«Ադրբեջանը մատնանշում է Արցախի 3 տարածքներ. «Դամաղլի 1» հանքավայրը, որը, ես ենթադրում եմ, Դրմբոնն է, Լաչինի «Գալաչա» ՀԷԿ–ը և Չարդախլիի հանքավայրը, որը, ենթադրում եմ, Կաշենն է, որն իրենց կարծիքով` ՄԱԿ–ը դատապարտել է, թե Հայաստանն այս հանքավայրերը շահագործելով` վնաս է պատճառել ԼՂ–ի շրջակա միջավայրին։ Նաև ասվում է, որ ՀՀ–ի հանքարդյունաբերության զարգացումը տարածաշրջանում առաջացրել է գետերի կենսամիջավայրի, ջրի, հողի քիմիական աղտոտում»,– ներկայացրեց Գրիգորյանը։
