Ալիսա Ռ․-ն 2022 թվականի փետրվար ամսից մինչև 2022 թվականի մարտի 17-ն ընկած ժամանակահատվածում պատշաճ կերպով չի կատարել իր երեխայի դաստիարակության և խնամքի պարտականությունը, որը դրսևորվել է դաժան վերաբերմունքով:

Այս մասին Iravaban.net-ը տեղեկանում է «Դատալեքս» դատական տեղեկատվական համակարգից։

Կինն իր ամուսնու հետ համատեղ կյանքում ունեցել է երկու երեխա տղա և աղջիկ։ Տղան ծնվել է 2019 թվականին։ Որդու նկատմամբ չունենալով ծնողական զգացմունք, իր կյանքում փոփոխություններ սպասվելու, երեխան իրենից ծնված չլինելու և երեխայի մոտ առողջական խնդիրների առկայության հանցավոր պատրվակով, պատշաճ կերպով չի խնամել անչափահաս որդուն։ Կինը որպես ծնող, գիտակցելով անչափահաս որդուն տարածքային պոլիկլինիկա բուժզննման ներկայացնելու, պետության կողմից անվճար հիմքունքներով տրամադրվող պատվաստումներ ստանալու անհրաժեշտությունը, երեխային չի ներկայացրել պոլիկլինիկա՝ այն հետաձգելով անհիմն պատճառաբանություններով:

Բացի այդ, Ալիսա Ռ․-ն իրենց բնակության վայրում անչափահաս որդուն տևական ժամանակ միայնակ է թողել, պահել և քնեցրել է չջեռուցվող սենյակում, չի հագցրել եղանակային պայմաններին համապատասխան հագուստ, այն պայմաններում, երբ տանը եղել է ջեռուցվող սենյակ, ինչի արդյունքում անչափահաս երեխայի վերջույթները ցրտահարվել են: Պատշաճ կերպով և քանակով երեխային տևական ժամանակ չի տրամադրել սնունդ, երեխային պահել է քաղցած վիճակում, ինչի արդյունքում տևական ժամանակ վերջինս գտնվել է թերսնված վիճակում:

Կինը չի խնամել երեխային, չի զբաղվել նրա հիգիենայով, պահել է լցված տակդիրով և թաց հագուստով: Չի հոգացել նաև անչափահասի հոգևոր և բարոյական զարգացման մասին, չի դաստիարակել վերջինիս, ինչի արդյունքում անչափահաս երեխան տևական ժամանակ չի քայլել, չի խոսել, եղել է մեկուսացված, ընկճված վիճակում, եղել է թերի զարգացած և վերջինիս զարգացման աստիճանը չի համապատասխանել նրա տարիքին, ինչն էլ հանգեցրել է երեխայի առողջության վատթարացման: Երեխայի մոտ առաջացել է շարժողական զարգացման հապաղում և խոսքի զարգացման հապաղում, որն էլ պայմանավորված է եղել նրա սոցիալ և հոգեհուզական իրավիճակով։

Գործը դատարան է ստացվել 2024 թվականի հուլիսի 18-ին և մակագրվել է Արարատի և Վայոց ձորի մարզերի առաջին ատյանի ընդհանուր իրավասության դատարանի դատավոր Միքայել Գրիգորյանին։

Ալիսա Ռ․-ին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 247-րդ հոդվածի 2-րդ մասի 1-ին կետի հատկանիշներով։ Այն է՝  ծնողի, այլ օրինական ներկայացուցչի կամ այլ անձի կողմից, որի վրա երեխայի դաստիարակության կամ խնամքի պարտականություն է դրված, այդ պարտականությունը չկատարելը կամ ոչ պատշաճ կատարելը, որը հանգեցրել է երեխայի առողջության վատթարացման, որը զուգորդվել է անչափահասի նկատմամբ դաժան վերաբերմունքով։

Կնոջ նկատմամբ խափանման միջոց է ընտրվել բացակայելու արգելքը։

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
