«Փաստ» օրաթերթը գրում է.

Տարածքային կառավարման և ենթակառուցվածքների նախարարությունն առաջարկում է փոփոխություն կատարել կառավարության 2012 թ. մարտի 22-ի N 437-Ն որոշման մեջ: Ներկայում «Ընդերքի մասին» օրենսգրքի 49-րդ հոդվածի 2-րդ մասի համաձայն՝ օգտակար հանածոյի արդյունահանման նպատակով ընդերքօգտագործման իրավունք ստանալու դիմումին կից ներկայացվող հանքի փակման ծրագիրը պետք է ներառի օգտակար հանածոյի արդյունահանման հետևանքով խախտված հողատարածքների ռեկուլտիվացիայի, ներառյալ՝ ռեկուլտիվացիայի ծրագիրը հանքի գոյության ընթացքում (ելնելով հանքավայրի շահագործման եղանակից), իսկ 59-րդ հոդվածի 3-րդ մասի 13-րդ կետով սահմանված է, որ օգտակար հանածոյի արդյունահանման իրավունք ստացած անձը պարտավոր է, նախագծի և օգտակար հանածոյի արդյունահանման պայմանագրի համաձայն, վերականգնել և բարելավել ընդերքօգտագործման հետևանքով խախտված հողամասերը (ռեկուլտիվացիա), ինչպես նաև դրանք պիտանի դարձնել տնտեսության մեջ օգտագործման համար կամ բերել անվտանգ վիճակի։
 
Նախատեսվող փոփոխությունը նպատակ ունի դիտարկել հանքի շահագործման ընթացքում խախտված հողատարածքների և ընդերքօգտագործման թափոնների օբյեկտների երկարաժամկետ տեղադրման տարածքների աստիճանական ռեկուլտիվացիան, որի արդյունքում ռեկուլտիվացիայի ամբողջ ծավալը չի մնա շահագործման ավարտին։ Ռեկուլտիվացման աշխատանքների ողջ ծավալը վերջում թողնելու դեպքում ընդերքօգտագործողի վրա առաջանում է թե՛ ֆինանսական, թե՛ տեխնիկական հսկայական բեռ, իսկ վերահսկող մարմնի կողմից կատարվող աշխատանքների պատշաճ վերահսկողության համար մարդկային և տեխնիկական ռեսուրսների անբավարարություն։
 
Որոշման ընդունման արդյունքում որպես պայմանագրային պարտավորություն կսահմանվի խախտված հողատարածքների և ընդերքօգտագործման թափոնների օբյեկտների փուլային ռեկուլտիվացիայի իրականացումը, ինչը կթեթևացնի ընդերքօգտագործողի բեռը՝ ողջ ռեկուլտիվացիոն աշխատանքները նախագծի ավարտի ժամանակ իրականացնելու համեմատ, ինչպես նաև հնարավորություն կտա ոլորտի տեսչական մարմնին ապահովել կատարվող ռեկուլտիվացիոն աշխատանքների պատշաճ վերահսկողություն, առկա բացերը ժամանակին բացահայտելու և ապահովելու վերականգնված տարածքների երկարաժամկետ կայունությունը:
