Արդարադատության միջազգային դատարանն ընդունել է Հայաստանի երեք առարկություններից երկուսը

Արդարադատության միջազգային դատարանը հրապարակել է Հայաստանի դեմ Ադրբեջանի հայցով Հայաստանի նախնական առարկությունների վերաբերյալ իր որոշումը։ Ինչպես «Հայաստանն ընդդեմ Ադրբեջանի» գործում, խոսքը Ռասայական խտրականության բոլոր ձևերի բացառման մասին կոնվենցիայի մասին է: Որոշման ամբողջական տեքստը հասանելի կլինի ավելի ուշ։ Եզրափակիչ մասը ընթերցել է դատավոր Նավաֆ Սալամը։ Հայաստանը երեք առարկություն է ներկայացրել:
Առաջինը վերաբերում է ժամանակաշրջանին՝ մինչև 1996 թվականի սեպտեմբերի 15-ի կեսերը, երբ Ադրբեջանը դեռ Կոնվենցիայի կողմ չէր։ Դատարանը հիշեցրել է, որ այս պահին Հայաստանը չի կարող պատասխանատվության ենթարկել Ադրբեջանին Կոնվենցիայի խախտման համար, քանի որ նա փաստաթղթի կողմ չի եղել։ Համապատասխանաբար, Դատարանը բավարարել է Հայաստանի առաջին առարկությունը։
Երկրորդ առարկությունը վերաբերում է ականապատմանն առնչվող Դատարանի բովանդակային լիազորություններին և այն պնդմանը, որ դա անմիջական առնչություն ունի «էթնիկ զտումների» քաղաքականությանը։ Միևնույն ժամանակ, դատարանը նշել է, որ Ադրբեջանը չի պահանջում, թե ականապատումն ինքնին ճանաչվի որպես Կոնվենցիայի խախտում։ Դատարանը մերժել է այս առարկությունը։
Երրորդ առարկությունը վերաբերում է Դատարանի իրավասությանը` քննելու Ադրբեջանի գանգատները բնապահպանական խնդիրների և վնասների վերաբերյալ: Դատարանը նշել է, որ Ադրբեջանի մատնանշած վնասը՝ անտառների, այգիների ոչնչացում, ենթակառուցվածքների ալիք, գետերի հուների փոփոխություններ, կարող էին առաջանալ Լեռնային Ղարաբաղի հարակից տարածքներում, և չի բացառել այնպիսի գործողությունները, որոնք կարող են դիտարկվել Կոնվենցիայի շրջանակում:
Միևնույն ժամանակ, դատարանը չի բացառել, որ փոփոխությունները կարող էին տեղի ունենալ գյուղատնտեսական գործունեության արդյունքում, իսկ Հայաստանի գործողությունները տեղի են ունեցել առևտրի կամ բիզնեսի ոլորտում։ Դատարանը համարում է, որ ջուրը կարող էր օգտագործվել հայերի կարիքների համար, և ադրբեջանական տարածքների դեգրադացումը կապված էր այդ գործունեության հետ, և արդյունքները կարող էին ազդել բոլոր էթնիկ խմբերի վրա և ուղղված չէին ադրբեջանցիների դեմ։ Այսինքն՝ եթե նույնիսկ գործողություններ են արվել, դրանք ուղղված չեն եղել էթնիկ խմբի դեմ։ Հայաստանի երրորդ առարկությունը Դատարանը ևս ընդունել է։
Ավելի վաղ դատարանը մերժել էր Ադրբեջանի նախնական առարկությունները Հայաստանի հայցի վերաբերյալ՝ ընդդեմ Ադրբեջանի։ Թե՛ Հայաստանի առարկությունների դեպքում, թե՛ Ադրբեջանի առարկությունների դեպքում հատուկ կարծիքներ կան։
