Դատարանը մերժել է Աբրահամ Գասպարյանին վարչական պատասխանատվության ենթարկելու ՆԳՆ հայցը

ՀՀ վարչական դատարանը՝ դատավոր Լուսինե Բոյաջյանի նախագահությամբ մերժել է ՆԳՆ ոստիկանության հայցն ընդդեմ Աբրահամ Գասպարյանի՝ վերջինիս վարչական պատասխանատվության ենթարկելու պահանջի մասին։
Ըստ ոստիկանության հայցի՝ հունիսի 12-ին մի խումբ քաղաքացիներ, այդ թվում՝ Աբրահամ Գասպարյանը, գտնվելով Դեմիրճյան-Բաղրամյան փողոցների խաչմերուկում, իրականացրել են բողոքի ակցիա հանրահավաք, խոչընդոտել են երթևեկության մյուս մասնակիցների ազատ տեղաշարժին: Ծառայություն իրականացնող ոստիկանության ծառայողները մոտեցել են նշված վայր և իբր պահանջել են քաղաքացիներից, այդ թվում՝ պատասխանողից, բացել ճանապարհը և խոչընդոտ չհանդիսանալ երթևեկության մյուս մասնակիցների համար, վերջիններիս տրվել է ողջամիտ ժամկետ, սակայն նրանք հրաժարվել են կատարել ոստիկանի օրինական պահանջը:
Ոստիկանության կողմից իրականացվել է վարչական վարույթ, որի վերաբերյալ կազմվել է թիվ 145 արձանագրությունը՝ Աբրահամ Գասպարյանի կողմից վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 182-րդ հոդվածով նախատեսված զանցանք կատարելու համար:
Ելնելով վերոգրյալից՝ ոստիկանությունը դատարանին խնդրել է Աբրահամ Գասպարյանին ենթարկել վարչական պատասխանատվության։
Այնուհետև, ոստիկանության ներկայացուցիչը չի ներկայացել դատական նիստին, թեև պատշաճ ծանուցված է եղել, և գործը քննվել է վերջինիս բացակայությամբ:
Աբրահամ Գասպարյանի ներկայացուցիչ, «Հայց» փաստաբանական գրասենյակի փաստաբան Էդգար Գրիգորյանն առարկել է վերոնշյալ հայցի դեմ և հայտնել, որ ոստիկանության ծառայողը կամ այլ ծառայող որևէ պահանջ չի ներկայացրել պատասխանողին կամ ներկա գտնվող քաղաքացիներին: Առանց որևէ հրահանգ կամ պահանջ ներկայացնելու, Գասպարյանին են մոտեցել ոստիկանության մոտ 10 ծառայողներ, ծեծի են ենթարկել և տեղափոխել են ոստիկանության Քանաքեռ-Զեյթունի բաժին, որը հայտնի փաստ է: Բռնություն գործադրելու հետ կապված և այլ փաստերի մասով նախաձեռնվել է քրեական վարույթ:
Դատարանն արձանագրել է, որ վարչական վարույթի նյութերով առհասարակ չի հաստատվում պահանջը առաջադրված լինելու և Աբրահամ Գասպարյանի կողմից չկատարելու հանգամանքը:
ՀՀ վարչական դատավարության օրենսգրքի 29-րդ հոդվածի 1-ին մասի համաձայն՝ եթե բոլոր ապացույցները հետազոտելուց հետո գործի ելքը պայմանավորող որևէ փաստ մնում է չապացուցված, ապա դրա բացասական հետևանքները կրում է այդ փաստի ապացուցման բեռը կրող կողմը:
Ուստի, դատարանը որոշել է ՀՀ ՆԳՆ ոստիկանության հայցն ընդդեմ Աբրահամ Գասպարյանի՝ վերջինիս վարչական պատասխանատվության ենթարկելու պահանջի մասին, մերժել:
«Դատարանի որոշումն օրինական ուժի մեջ է մտնում կայացման պահից մեկ ամիս հետո և կարող է բողոքարկվել ՀՀ վերաքննիչ վարչական դատարան՝ մինչև դրա օրինական ուժի մեջ մտնելու համար սահմանված ժամկետը: Կարծում եմ, որ ՀՀ ՆԳՆ Ոստիկանությունը սույն գործով վերաքննիչ բողոք կտանի։ Ամեն դեպքում, պատրաստ ենք պարոն Գասպարյանի շահերը ներկայացնել նաև այդ փուլում։», – իր խոսքում նշել է Էդգար Գրիգորյանը։
