Կրթության, գիտության, մշակույթի և սպորտի նախարարությունը պարզաբանում է տարածել, որում ասվում է․

Հաշվի առնելով որոշ ԶԼՄ-ներում շրջանառվող ոչ ստուգ տեղեկությունները` հայտնում ենք.

Պատմամշակութային հուշարձանների պահպանության ոլորտը կարգավորվում է մի շարք իրավական ակտերով, այդ թվում՝ «Պատմության և մշակույթի անշարժ հուշարձանների ու պատմական միջավայրի պահպանության և օգտագործման մասին» ՀՀ օրենքով: Այդ օրենքի 36-րդ հոդվածը սահմանում է հուշարձանի սեփականատիրոջ պարտականությունները, որոնցից մեկն է՝ սահմանված կարգով տալ հուշարձանի պահպանական պարտավորագիր լիազորված մարմնին` հանրապետական նշանակության հուշարձանի դեպքում կամ պետական կառավարման տարածքային մարմնին (Երևան քաղաքում՝ ՀՀ տարածքային կառավարման ոլորտի նախարարությանը)` տեղական նշանակության հուշարձանի դեպքում:

ՀՀ ԿԳՄՍ նախարարի 2023 թ. դեկտեմբերի 7-ի N 145-Ն հրամանով հաստատվել է պահպանական պարտավորագրի օրինակելի ձևը, որից հետո նախարարությունը, համագործակցելով մարզպետարանների և համայնքապետարանների հետ, սկսել է հուշարձանների սեփականատերերի հետ պահպանական պարտավորագրերի ստորագրման գործընթացը: 2024 թ. ընթացքում հուշարձանների սեփականատերերի հետ արդեն կնքվել են 200-ից ավելի պահպանական պարտավորագրեր:

Մեկ անգամ ևս տեղեկացնում ենք, որ պահպանական պարտավորագրի կնքումը նպատակ ունի հենց սեփականատերերին ծանոթացնել իրենց պարտականություններին, որպեսզի բացառվեն հուշարձանների քանդման, օրենքի խախտմամբ ձևափոխման և այլ ապօրինի դեպքերը: Պահպանական պարտավորագրերի կնքումը որևէ կերպ չի ազդում սեփականատերերի սեփականության իրավունքի վրա և չի առաջացնում որևէ նոր պարտավորություն, որն արդեն սահմանված չէ օրենքով և իրավական այլ ակտերով:

Տեղեկացնում ենք, որ օրենքով սահմանված պարտականությունից հրաժարվելը՝ ՀՀ ԿԳՄՍ նախարարի 2023 թ դեկտեմբերի 7-ի N 145-Ն հրամանով հաստատված պահպանական պարտավորագիրը չստորագրելը, պատմության և մշակույթի հուշարձանների պահպանության կամ օգտագործման կանոնների խախտում է: Վերջինս առաջացնում է տուգանք «Վարչական իրավախախտումների վերաբերյալ» ՀՀ օրենսգրքի 95-րդ հոդվածով: Այն սեփականատերերը, որոնք սահմանված կարգով տալիս են պահպանական պարտավորագիր, ենթակա չեն տուգանքի»։
