Monument Watch. 2024 թվականի դեկտեմբերի 17-ին Tik-Tok հարթակում տարածվեց մի տեսանյութ, որտեղ հստակ երևում է, որ  ադրբեջանական կողմը օկուպացված Արցախի Հաթերք գյուղում ավերել է Հայրենական պատերազմի զոհերի հիշատակին նվիրված հուշարձանը(https://www.tiktok.com/@09_parfum/video/7449331303104728327?_t=8sJuU8mUwlj&_r=1):

Հուշարձանը կառուցվել էր 1965-1966 թվականներին՝ գյուղի կենտրոնում: Հաթերք գյուղից Հայրենական պատերազմին մասնակցել է 400 մարտիկ, որոնցից 195 զոհվել են (Բալայան 2020, 314): Հուշարձանն իրենից ներկայացնում էր աղբյուր-հուշակոթող, որի վրա արձանագրված են եղել զոհված հաթերքցիների անուն ազգանունները (նկ. 1): Հուշարձանը որոշակիորեն տուժել էր նաև Արցախյան առաջին պատերազմի տարիներին. նրա վրա անզեն աչքով էլ երևում են ինքնաձիգով կրակահերթի հետքերը:

Մեր արձագանքը

Արցախի Հաթերքի շրջանի Հայրենական պատերազմի զոհերի հիշատակին նվիրված հուշարձանի կանխամտածված ոչնչացումը խախտում է Հռոմի Ստատուտի  8-րդ հոդվածը  և համարվում մարդկության դեմ ծանր հանցագործություն։ Հուշարձանին հասցված վնասը համաձայն «Զինված հակամարտությունների ժամանակ մշակութային արժեքների պաշտպանության մասին» Հաագայի 1954 թ. կոնվենցիայի 4-րդ հոդվածի և լրացուցիչ՝ 1999 թ. ընդունված Երկրորդ արձանագրության 15-րդ հոդվածի ա կետի, «լուրջ խախտում» է, որը՝ որպես ռազմական հանցագործություն, կարող է հետապնդվել միջազգային դատարաններում։

Հուշարձանի ոչնչացումը նաև խախտում է Միջազգային մարդասիրական իրավունքի  38-րդ, 39-րդ, 40-րդ  և  41-րդ կանոնները։ Հույժ կարևոր է ընդգծել այն հանգամանքը, որ  Արդարադատության միջազգային դատարանը հաստատել է, որ օկուպացված տարածքներում գործող օրենքները՝ ներառյալ մշակութային արժեքների պաշտպանության դրույթները,  ձեռք են բերել միջազգային սովորութային իրավունքի (infra Jurisprudence) կարգավիճակ, այսինքն գործում են որպես համընդհանուր և անշրջանցելի կանոն և պարտադիր են  բոլոր պետությունների համար։

Հարկ է հավելել, որ Հայրենական մեծ պատերազմին նվիրված հուշարձանների ոչնչացումը Ադրբեջանի պետական քաղաքականության ուղղություններից է և 2020 թվականի պատերազմից ի վեր, արդեն իսկ ոչնչացվել են Հադրութի ազատամարտիկներին նվիրված հուշարձանը (https://monumentwatch.org/hy/alerts/հադրութի-ազատամարտիկների-հուշարձանի/), Շուշիի Արցախյան ազատամարտի և Հայրենական պատերազմի զոհերի հիշատակին նվիրված հուշահամալիրը (https://monumentwatch.org/hy/alerts/շուշիում-հայոց-ցեղասպանության-զոհեր/)։  Բացի այդ, Հադրութի Ազոխ գյուղում ավերվել են երեք առանձին հուշարձաններ՝ նվիրված Հայրենական մեծ պատերազմի, Արցախյան առաջին պատերազմի և Հայոց ցեղասպանության զոհերի հիշատակին (https://monumentwatch.org/en/alerts/destruction-of-the-memorial-complex-in-azokh-village-of-hadrut/)։
