ԶՊՄԿ-ն հաղթել է Հայկական բնապահպանական ճակատին զրպարտության գործով

Զանգեզուրի պղնձամոլիբդենային կոմբինատը հերթական՝ թվով 7-րդ հաղթանակն է տարել դատարանում՝ ընկերության դեմ զրպարտության հայցերով։ Այս անգամ դատարանն ամբողջությամբ բավարարել է Ընկերության հայցն ընդդեմ Հայկական բնապահպանական ճակատ (ՀԲՃ) կամավորական քաղաքացիական նախաձեռնության՝ զրպարտություն համարվող տեղեկությունը հրապարակայնորեն հերքելու պահանջը, իսկ զրպարտություն տարածելու համար փոխհատուցման մասով պատասխանողին պարտավորեցրել է վճարել 500․000 դրամ։ Այս մասին տեղեկանում ենք «Դատալեքս» դատական-տեղեկատվական համակարգից։

Դատարանի որոշման համաձայն՝ ՀԲՃ նախաձեռնությունը պարտավոր է հրապարակայնորեն հերքել իր ֆեյսբուքյան անձնական օգտահաշվում 2023թ․ հուլիսի 11-ին հայտարարությունում տեղ գտած «անցյալում էկոլոգիական հանցանքների համար անպատիժ մնացած, ներկայումս անպատասխանատու գործունեության ծավալող (միայն Արծվանիկի պոչամբարն ու Ողջի գետի պարբերական աղտոտումը բավարար է) անհասկանալի ձևերով ՀՀ կառավարությանը բաժնեմաս նվիրած ԶՊՄԿ-ն», «ԶՊՄԿ-ն է աղտոտում է բնությունն ու վնաս հասցնում մարդկանց առողջությանը» զրպարտություն համարվող և ԶՊՄԿ-ին վերաբերող փաստացի տվյալները:

Լրատվամիջոցների եւ հասարակական կազմակերպությունների դեմ զրպարտության մեղադրանքով ընկերությունների հայցերը միանշանակ չեն ընկալվում, եւ հասարակական կազմակերպությունները ու ԶԼՄ-ները մեղադրում են իրենց դեմ հայցեր ներկայացնող ընկերություններին «լռեցնելու» փորձի մեջ։ ԶՊՄԿ Լրատվության և հասարակության հետ կապերի բաժնի պետ Արայիկ Մարգարյանն՝ ի պատասխան հայցերի մասին մեր հարցադրմանն, ասել է հետևյալը. «Զրպարտությունը, կեղծիքը եւ ապատեղեկատվությունը հանրային ոչ մի շահի չեն ծառայում։ Ավելին, ինչպես տեսել ենք վերջին տարիներին, հանքարդյունաբերության դեմ տարիներով հնչեցրած զրպարտությունը, որը հանքարդյունաբերական ընկերությունները գերադասել են անտեսել, այսօր օգտագործվում է Հայաստանի դեմ՝ Ադրբեջանի կողմից»։

«Շատ կարևոր է, որ վերջին դատական որոշումներում հստակ նշվում է, որ հրապարակումները պարունակում են զրպարտանք։ Դատական հայցերը որևէ մեկին լռեցնելու համար չեն, այլ նպատակ ունեն, այդ թվում՝ հանրային հարթակում, համացանցում ֆիքսելու, որ հնչեցվածը զրպարտություն է, ապագայում այդ ապատեղեկատվության շահարկումներից խուսափելու համար»։

Հիշեցնենք, որ ավելի վաղ դատարանը բավարարել էր Զանգեզուրի պղնձամոլիբդենային կոմբինատի զրպարտության մասին հայցադիմումները «Դատաբլոգ» ընկերությանը պատկանող «Blognews.am», ինչպես նաև «Օրագիր Մեդիա» ընկերության կողմից գործարկվող «Oragir.News» կայքերի դեմ։
