Տարածական տվյալների տրամադրումը կիրականացվի վճարովի հիմունքներով․ «Փաստ»

«Փաստ» օրաթերթը գրում է.
Կադաստրի կոմիտեն առաջարկում է փոփոխություններ կատարել «Տարածական տվյալների մասին» և «Գույքի նկատմամբ իրավունքների պետական գրանցման մասին» օրենքներում: «Տարածական տվյալների մասին» օրենքի 19-րդ հոդվածի 6-րդ մասի համաձայն՝ օրենքի 19-րդ հոդվածով սահմանված տեղեկատվությունը և դրան առնչվող ծառայությունները բուհերին և գիտահետազոտական կենտրոններին շահույթ չստանալու՝ ուսումնական և գիտահետազոտական աշխատանքների իրականացման նպատակով, ինչպես նաև Հանրապետության նախագահի, վարչապետի, ԱԺ աշխատակազմերին և պատգամավորներին, պետական կառավարման մարմիններին, մարզպետարաններին, դատարաններին, դատախազությանը և քրեական հետապնդման այլ մարմիններին, Կենտրոնական բանկին, ինքնավար մարմիններին և անկախ պետական մարմիններին, Մարդու իրավունքների պաշտպանին, հանրային պաշտպանի գրասենյակի ղեկավարին տրամադրվում են անվճար՝ ՀՀ օրենքով իրենց վերապահված լիազորությունների իրականացման համար: Պետական մարմիններին ու պաշտոնատար անձանց՝ այս մասով սահմանված կարգով տրամադրված տեղեկատվությունը, ինչպես նաև կադաստրային, տեղագրական կամ հողաշինարարական քարտեզները վերջիններս կարող են փոխանցել այլ անձանց միայն կառավարության որոշման հիման վրա, որոնց համար գանձվում են այս օրենքով սահմանված վճարները: Բացի այդ, օրենքի 19-րդ հոդվածի 7-րդ մասի համաձայն՝ ֆիզիկական, իրավաբանական անձինք, ինչպես նաև ՏԻՄ-երն իրենց գույքի մասին հայցվող տեղեկատվության համար (մինչև 10 էջ պատճենահանված փաստաթղթերի մասով) ազատվում են տեղեկատվության տրամադրման վճարից:
«Գույքի նկատմամբ իրավունքների պետական գրանցման մասին» օրենքի 11-րդ հոդվածի 6-րդ մասի պահանջների համաձայն՝ անշարժ գույքի պետական միասնական կադաստրի տեղեկատվության կազմից տեղեկությունները փաստաթղթերից պատճենների ձևով և անվճար հիմունքներով տրամադրվում են համապատասխան մարմիններին, մինչդեռ հիշյալ փաստաթղթերն իրենց մեջ պարունակում են որոշակի տարածական տվյալներ, օրինակ՝ անշարժ գույքի գտնվելու վայրի, տեսքի և այլ հատկությունների մասին տվյալներ, հատակագծեր, կադաստրային քարտեզներ։
Նախագծի ընդունման արդյունքում Կադաստրի կոմիտեի կողմից տարածական տվյալների տրամադրումը բոլոր, այդ թվում՝ պետական կառավարման համակարգի մարմիններին կնախատեսվի իրականացնել վճարովի հիմունքներով:
«Գույքի նկատմամբ իրավունքների պետական գրանցման մասին» օրենքում փոփոխությունների նախագծով ակնկալվում է, որ նույն օրենքի 11-րդ հոդվածի 5-րդ մասով նախատեսված տեղեկատվությունը փաստաթղթերի պատճենների ձևով համապատասխան մարմիններին կտրամադրվի վճարովի, իսկ անշարժ գույքի պետական միասնական կադաստրի գրանցման մատյանում առկա տվյալների մասին տեքստային տեղեկատվությունը՝ անվճար հիմունքներով։
