Հ․ Ա․-ն 2024 թվականի օգոստոսի 29-ին՝ ժամը 15:30-ի սահմաններում, կենցաղային հարցերի շուրջ առաջացած վիճաբանության ժամանակ, անչափահաս դստեր ներկայությամբ, նախկին կնոջ հասցեին հնչեցրել է սպանության սպառնալիքներ, ասելով՝ վերջին անգամ ես տեսնում մայրիկիդ, տանելու եմ սպանել։ Այնուհետև ձեռքերով և ոտքերով հարվածներ է հասցրել նախկին կնոջ մարմնի տարբեր մասերին։

Ըստ մեղադրական եզրակացության՝ տղամարդուն արգելված է եղել այցելել իր հետ համատեղ չբնակվող նախկին կնոջը, ինչպես նաև նրա խնամքի տակ գտնվող անձանց, նրանց աշխատանքի, ուսման, հանգստի, բնակության վայրեր, ինչպես նաև 20 օր ժամկետով 50 մետր հեռավորությունից ավելի չմոտենալ վերջիններիս։ Հ․ Ա․-ն՝ խախտելով նշված անհետաձգելի միջամտության որոշման պայմանները, 2024 թվականի սեպտեմբերի 9-ին՝ ժամը 11:30-ի սահմաններում մոտեցել է նախկին կնոջն ու անչափահաս որդուն և սպառանլիքն իրականացնելու իրական վտանգի առկայության պայմաններում, նախկին կնոջ հասցեին հնչեցրել է սպանության սպառնալիքներ, ասելով՝ սպանելու եմ, արյունդ խմելու եմ, ժամերդ հաշված են:

Գործը դատարան է ստացվել փետրվարի 7-ին։

Հ․ Ա․-ին մեղադրանք է առաջադրվել Քրեական օրենսգրքի 194-րդ հոդված 2-րդ մասի հատկանիշնեով, երկու դրվագ (Սպանության, առողջությանը վնաս պատճառելու, խոշտանգման, սեռական ազատության կամ անձեռնմխելիության դեմ ուղղված հանցանք կատարելու, առևանգելու, ազատությունից ապօրինի զրկելու կամ խոշոր կամ առանձնապես խոշոր չափի գույք ոչնչացնելու սպառնալիքը, եթե այդ սպառնալիքն իրականացնելու իրական վտանգ է եղել, ինչպես նաև սոցիալական մեկուսացումը կամ պարբերաբար պատիվն ու արժանապատվությունը նվաստացնելը)։ 195-րդ հոդվածի 2-րդ մասի 6-րդ կետի հատկանիշներով (Հարվածներ հասցնելը կամ բռնի այլ գործողություններ կատարելը, եթե չեն առաջացել սույն օրենսգրքի 171-րդ հոդվածով նախատեսված հետևանքները, որը կատարվել է մերձավոր ազգականի, զուգընկերոջ կամ նախկին զուգընկերոջ կողմից)։ 508-րդ հոդվածի 1-ին մասին հատկանիշներով (Անհետաձգելի միջամտության որոշումը կամ պաշտպանական որոշումը չկատարելը):

Նրա նկատմամբ խափանման միջոց է ընտրվել՝ բացակայելու արգելքը։

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
