Դատական գործերի վերաքննություն իրականացնելիս առաջարկվում է սահմանել բողոքների քննության գրավոր ընթացակարգ. նախագիծ․ «Փաստ»

«Փաստ» օրաթերթը գրում է.
Արդարադատության նախարարությունն առաջարկում է փոփոխություններ և լրացումներ կատարել Քրեական դատավարության օրենսգրքում: Ըստ նախագծի հեղինակների, դատական և իրավական բարեփոխումների 2021-2026 թթ. ռազմավարությամբ ամրագրվեցին անհրաժեշտ մի շարք գործողություններ՝ կապված դատարանների ծանրաբեռնվածության թեթևացման, դատական համակարգի բարեփոխումների, քրեաիրավական, քաղաքացիական և վարչական դատավարության, սնանկության, վեճերի լուծման այլընտրանքային եղանակների հետ։ Նշվում է՝ դատարանների գործունեության վիճակագրությունը ցույց է տալիս, որ առաջին ատյանի դատարանների կողմից քննված մեծաքանակ քրեական գործեր բողոքարկվում են վերաքննիչ դատարանում: Մասնավորաբար՝ ՀՀ ընդհանուր իրավասության դատարաններում քրեական գործերի քննության ընդհանուր թիվը 2024 թվականին կազմել է 3394, որից բողոքարկված վարութային ակտերի ընդհանուր թիվը կազմել է 1725: Վերաքննիչ քրեական դատարանի 2024 թ. գործունեության վերաբերյալ հաշվետվությամբ նշվել է, որ հաշվետու ժամանակահատվածի սկզբում նախորդ հաշվետու ժամանակահատվածից փոխանցված գործերի ընդհանուր թիվը կազմել է 558 գործ: Իսկ հաշվետու ժամանակահատվածում ստացված բողոքների ընդհանուր թիվն է մոտ 8674 գործ:
Նախագծով առաջարկվում է գրավոր ընթացակարգով իրականացվող վարույթներում ներառել նաև օրենսգրքի 46-րդ գլխով նախատեսված վարույթը։ Մասնավորապես, դատական վերանայման ինստիտուտում վերաքննություն իրականացնելիս առաջարկվում է սահմանել բողոքների քննության գրավոր ընթացակարգ։ Այլ կերպ՝ ամրագրվում է վերաքննիչ բողոքները գրավոր ընթացակարգով քննելու ընդհանուր օրենսդրական կանխավարկած՝ սահմանելով ինչպես այդ մասին վերաքննիչ դատարանի կողմից որոշում կայացնելու պահը, այնպես էլ՝ վերաքննիչ բողոքարկման ընթացքում ապացույցներ հետազոտելու միջնորդություն և վերաքննիչ բողոքի քննության ընթացքում բողոքի սահմաններից ի շահ մեղադրյալի դուրս գալու դեպքերում բանավոր ընթացակարգով բողոքների քննության առանձնահատկությունները։
Նախագծով առաջարկվում է նաև վերաքննիչ բողոքների՝ դատական նիստում քննելու իրավական հնարավորություն։ Մասնավորապես, բոլոր այն դեպքերում, երբ վերաքննիչ դատարանը գործին մասնակցող անձի միջնորդությամբ կամ իր նախաձեռնությամբ կգա եզրահանգման, որ անհրաժեշտ է վերաքննիչ բողոքի քննությունն իրականացնել դատական նիստում, գործի քննության ցանկացած փուլում կարող է որոշում կայացնել վերաքննիչ բողոքը դատական նիստում քննելու մասին՝ գրավոր ընթացակարգով իրականացող վարույթը փոխակերպելով բանավոր ընթացակարգի։
Առաջարկվող փոփոխություններով հնարավորություն է ընձեռվում նաև ողջամիտ ժամկետ սահմանել դատարանի համար՝ վճիռը կողմերին ուղարկելու պարտականության ապահովման տեսանկյունից։ Առաջարկվում են այլ փոփոխություններ ևս: Ակնկալվում է վերաքննիչ բողոքների գրավոր ընթացակարգով քննության միջոցով թոթափել դատարանների ծանրաբեռնվածությունը, ապահովել գործերի քննության ողջամիտ՝ առավել կարճ ժամկետներ, դատական ակտերի պատշաճ ծանուցումների ապահովման տեսանկյունից ապահովել իրական և օբյեկտիվ հնարավորություն օրենսգրքով սահմանված ժամկետներում իրականացնել դատավճիռը կողմերին ուղարկելու պահանջը։
