Ադրբեջանն ու Հունգարիան Սաֆարովի գործով ՄԻԵԴ-ի հարցերին պետք է պատասխանեն մինչև մայսիսի 12-ը

Մարդու իրավունքների եվրոպական դատարանը Ադրբեջանին և Հունգարիային մինչև մայիսի 12-ը ժամանակ է տվել պատասխանելու ադրբեջանցի ոճրագործ Ռամիլ Սաֆարովին արտահանձնելու և վաղաժամ ազատ արձակելու գործով դատարանի կողմից այդ պետություններին ուղղված հարցերին: Ինչպես «Արմենպրես»-ի հետ զրույցում նշեց ՄԻԵԴ-ում դիմումատու` հայ սպա Գուրգեն Մարգարյանի հարազատների շահերի պաշտպան Նազելի Վարդանյ անը, դիմող կողմը ձգտում է ամեն ինչ անել, որ Հայաստանի Հանրապետությունը ճանաչվի կողմ, քանի որ Գուրգեն Մարգարյանը Հայաստան պետությունը ներկայացնող զինծառայող էր, երբ դաժանաբար սպանվեց ադրբեջանցի ոճրագործ Սաֆարովի կողմից: «Այն, որ դատարանը գործն ընդունել է վարույթ և արդեն մեկնարկել է հաղորդակցության փուլը, մեծ առաջընթաց է: Մենք դրան երեք տարի սպասել ենք, քանի որ հայցը ներկայացրել էինք 2013թ. փետրվարի 28-ին»,-ասաց Վարդանյանը:
ՄԻԵԴ-ում Գուգեն Մարգարյանի հարազատների շահերը ներկայացնում են նաև ՄԻ եվրոպական փաստաբանական կենտրոնը, հայկական հասարակական Legal Guide կազմակերպությունը: Գանգատում պահանջվում է ճանաչել, որ Հունգարիայի կողմից Ադրբեջանին մարդասպան Ռամիլ Սաֆարովի փոխանցումը եւ Ադրբեջանի կողմից նրա ներումը, ըստ էության` արդարացումը եւ հերոսացումը խախտում է Մարդու իրավունքների եվրոպական կոնվենցիայի 2-րդ հոդվածով (այն է՝ կյանքի իրավունք),14-րդ հոդվածով (խտրականության արգելք) ամրագրված հիմնարար իրավունքները: Մարդու իրավունքների եվրոպական դատարանը կարող Õ § պարտավորեցնել ոճրագործին հետ հանձնել Հունգարիային կամ կրել պատժի մնացած մասը հենց Ադրբեջանում: Վճիռը կարող է ենթադրել նաև դրամական պատասխանատվություն:
Մարգարյանի հարազատները նաև շեշտում են, որ հայ սպան զոհ է դարձել ազգային ատելության հողի վրա կատարված հանցագործության, որն ավելի ուշ արդարացում է ստացել մարդասպանին ներում շնորհելու և ազատ արձակելու միջոցով։ Հունգարիան իր հերթին ինչպես ընդգծել են գանգատ ներկայացնողները, արտահանձնել է Սաֆարովին Ադրբեջանին առանց երաշխիքներ ստանալու, որ հանցագործն այդ երկրում կրելու է իր դատավճռով սահմանված պատիժն ամբողջությամբ։ Գանգատ է ներկայացրել նաև Հայկ Մակուչյանը, որին, ինչպես պարզել է դատարանը, ցանկացել է սպանել Սաֆարովը Բուդապեշտում նույն մÕ �ջադեպի ժամանակ։
2004թ. փետրվարի 19-ի գիշերը Ռամիլ Սաֆարովը թաքուն մտել էր Գուրգեն Մարգարյանի սենյակը եւ կացնահարել քնած հայ սպային: Երկարատեւ դատական գործընթացից հետո 2006թ. ապրիլին Սաֆարովը Բուդապեշտի դատարանի կողմից ցմահ ազատազրկման էր դատապարտվել` 30 տարի առանց ներման իրավունքի: Հունգարական դատարանը բազմիցս էր հայտարարել Սաֆարովի` հայրենիքին արտահանձնելու անհնարինության մասին, սակայն 2012թ. օգոստոսի 31-ին Սաֆարովին արտահանձնեցին Ադրբեջանին, որտեղ մարդասպանին Նախագահ Ալիեւն անմիջապես ներում շնորհեց, զինվորական բարձր կոչում տÕ �եց եւ միանվագ վճարեց 8 տարվա աշխատավարձը: Նույն օրը պաշտոնական Երեւանը խզեց դիվանագիտական հարաբերությունները Բուդապեշտի հետ:
Թուրքիայում հատուկ պատրաստություն անցած Ադրբեջանի ԶՈւ սպա Ռամիլ Սաֆարովը 2004թ. փետրվարին մասնակցում էր ՆԱՏՕ-ի «Գործընկերություն հանուն խաղաղություն» ծրագրի շրջանակում անգլերենի դասընթացներին, որին մասնակցում էին նաեւ հայ սպաներ Գուրգեն Մարգարյանն ու Հայկ Մակուչյանը:
