Բացահայտվել է ՀՀ ՊՆ զորամասի հրամանատարի կողմից 2 մլն դրամի գույքի հափշտակության դեպք

ՀՀ հակակոռուպցիոն կոմիտեում քննված քրեական վարույթով կատարված նախաքննությամբ հիմնավորվել է, որ ՀՀ ՊՆ N զորամասի հրամանատար Տ. Մ.-ն, պատասխանատու լինելով գնդի նյութական միջոցների պահպանության համար, խմբի կազմում հափշտակել է իր տիրապետմանը հանձնված 2 մլն ՀՀ դրամ արժողությամբ գույք: Հայտնում են կոմիտեից:
Նախաքննությամբ հիմնավորվել է, որ Տ. Մ.-ն զորամասի հաշվեկշռում առկա 2 մլն ՀՀ դրամ արժողությամբ գույք հափշտակելու դիտավորությամբ, հանձնարարել է նույն զորամասի ավտոմոբիլային ջոկի վարորդ Գ. Դ.-ին և պահեստապետ Կ. Ա.-ին զորամասի պահեստից հանել ընդհանուր 10 տոննա դյուրալյումինից պատրաստված զրահատեխնիկայի շարժիչի՝ օգտագործման համար ոչ պիտանի պահեստամասերն ու վաճառել:
Մասնավորապես՝ Տ. Մ.-ի հանձնարարությամբ զորամասի ինժեները, տեղյակ չլինելով ավտոմեքենայի շահագործման իրական նպատակի և երթուղու մասին, կազմել է կեղծ ուղեգրեր, որոնց հիման վրա Գ. Դ.-ն և Կ. Ա.-ն զրահատեխնիկայի շարժիչի՝ օգտագործման համար ոչ պիտանի պահեստամասերը բարձել են զորամասին ամրակցված բեռնատարը և 2024 թվականի փետրվարի 2-ից մայիսի 3-ն ընկած ժամանակահատվածում տեղափոխել Կոտայքի մարզի բնակավայրերից մեկը, որտեղ հիշյալ պահեստամասերը բեռնաթափել են Գ. Դ.-ին պատկանող հողամասերի տարածքում: Այնուհետև վերջինս, հիշյալ պահեստամասերը վաճառելու՝ Տ. Մ.-ի ապօրինի հանձնարարությունը կատարելու նպատակով, պայմանավորվածություն է ձեռք բերել մետաղի ջարդոն ընդունող անձի հետ և հափշտակված պահեստամասերը՝ մեկ կիլոգրամը 400 ՀՀ դրամով, վաճառել նրան: Արդյունքում՝ ստացված 4 մլն ՀՀ դրամից 3 մլն դրամը Գ. Դ.-ն տվել է Տ. Մ.-ին, իսկ գումարի մնացած մասը՝ 1 մլն ՀՀ դրամը, տնօրինել են ինքն ու պահեստապետ Կ. Ա.-ն: Վերջիններիս կողմից հիշյալ 1 մլն դրամը նախաքննության ընթացքում ամբողջությամբ վերականգնվել է:
Վերը նշված հանցավոր արարքների կատարման համար Տ. Մ.-ին մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 256-րդ հոդվածի 2-րդ մասի 2-րդ և 3-րդ կետերով և 445-րդ հոդվածի 1-ին մասով, Գ. Դ.-ին՝ 46-256-րդ հոդվածի 2-րդ մասի 2-րդ և 3-րդ կետերով, իսկ Կ. Ա.-ին՝ 46-256-րդ հոդվածի 2-րդ մասի 2-րդ և 3-րդ կետերով:
Քրեական վարույթով նախաքննությունն ավարտվել է: Դատախազի կողմից հաստատվել է մեղադրական եզրակացությունը, և վարույթի նյութերն ուղարկվել են դատարան՝ ըստ էության քննելու համար:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
