Ադրբեջանի իշխանությունները պետք է անհապաղ ազատ արձակեն ՀՀ քաղաքացիներին։ Այս մասին ասվում է Եվրախորհրդարանի բանաձևում, որն այսօր ընդունվեց 464 կողմ, 115 դեմ և 39 ձեռնպահ ձայներով։

Փաստաթղթում նշվում է, որ Ադրբեջանում շարունակում են պահվել 23 հայ պատանդներ (սահմանումը` տեքստի բնօրինակից), այդ թվում` Լեռնային Ղարաբաղի նախկին պաշտոնյաները, ինչպես նաև 2020 թվականի պատերազմից և դրան հաջորդած էթնիկ զտումներից հետո գերեվարված անձինք։

Եվրախորհրդարանը շեշտում է, որ այդ մարդկանց նկատմամբ բեմականացված դատավարություններ են ընթանում, նրանց խիստ դատավճիռներ են սպառնում` ընդհուպ մինչև ցմահ ազատազրկում։ Դատավարության ընթացքում նրանք ենթարկվում են անմարդկային վերաբերմունքի` ներառյալ արգելված հոգեներգործուն նյութերի օգտագործումը։ Պարբերաբար խախտվում են անկախ պաշտպանության, թարգմանիչների, բողոքարկման, հարազատների հետ հանդիպումների և առողջական պատճառներով դատական նիստերը հետաձգելու նրանց իրավունքները։

Բանաձևում ընդգծվում է նաև, որ մեղադրյալներից մեկը` Ռուբեն Վարդանյանը, շարունակում է հացադուլը, ինչի պատճառով նրա վիճակը, ինչպես նաև մյուս ձերբակալվածների վիճակը, կտրուկ վատանում է։ Եվրախորհրդարանը Ադրբեջանի իշխանություններին կոչ է անում ապահովել նրանց իրավունքները, այդ թվում` բժշկական օգնության հասանելիությունը, ինչպես նաև նրանց պահման պայմանների անկախ հետաքննության հնարավորություն ընձեռել:

Փաստաթղթում ուշադրություն է հրավիրվում նաև Ադրբեջանում Կարմիր խաչի և ՄԱԿ-ի գործակալությունների գրասենյակների փակման վրա, ինչը լուրջ մտահոգություն է առաջացնում։ Այդ կապակցությամբ Եվրախորհրդարանը կոչ է անում Բաքվում ԵՄ ներկայացուցչությանը և ԵՄ անդամ երկրների դեսպանատներին պարբերաբար վերահսկել դատավարությունները և այցելել կալանավորված հայերին։

Առանձին կոչ է հասցեագրված Մարդու իրավունքների հարցերով ԵՄ հատուկ ներկայացուցչին։

Բացի այդ, Եվրախորհրդարանը խորհուրդ է տալիս միջազգային պատժամիջոցներ սահմանել մարդու իրավունքների խախտումներին մասնակից անձանց, այդ թվում ՝ դատախազ և դատավորներ Ջամալ Ռամազանովի, Անար Ռզաևի և Զեյնալ Աղաևի դեմ:

Եվրախորհրդարանը Միջազգային քրեական դատարանին առաջարկում է քննել Լեռնային Ղարաբաղում հայերի բռնի տեղահանման և էթնիկ զտումների դեպքերը։ Փաստաթղթումնաև պահանջ կա ՄԱԿ–ի միջազգային դատարանի որոշումների լիարժեք կատարման մասին, այդ թվում` 2020 թվականի պատերազմի և հետագա ռազմական գործողությունների արդյունքում գերեվարված բոլոր ձերբակալվածների պաշտպանության մասով:

Եվրախորհրդարանը հերթական անգամ կոչ է արել կասեցնել էներգետիկ ոլորտում ռազմավարական գործընկերության վերաբերյալ ԵՄ-Ադրբեջան հուշագիրը, որն ընդունվել է 2022 թվականին։ Բացի այդ, Եվրախորհրդարանի պատգամավորները պնդում են, որ ԵՄ-ի և Ադրբեջանի միջև ցանկացած ապագա համաձայնագիր ներառի բոլոր քաղբանտարկյալներին ազատ արձակելու, Հայաստանի հետ խաղաղության պայմանագրի շուրջ բանակցությունների արհեստական ձգձգումից Բաքվի հրաժարվելու և Լեռնային Ղարաբաղի հայերի իրավունքների պահպանման երաշխիքների պարտավորություններ։
