Գյումրիում ձերբակալվածներից 5-ի նկատմամբ խափանման միջոց է կիրառվել վարչական հսկողությունը, 3-ի նկատմամբ՝ բացակայելու արգելքը

Ինչպես արդեն տեղեկացվել է, ընտրակաշառք տալու, ստանալու, ինչպես նաև ընտրության ժամանակ բարեգործության արգելքը խախտելու առերևույթ հանցագործությունների դեպքերի առթիվ ՀՀ հակակոռուպցիոն կոմիտեում քննվող քրեական վարույթների շրջանակում նախօրեին ձերբակալվել էր 8 անձ՝ ազատության մեջ գտնվող մեղադրյալներին դատարան ներկայացնելու հիմքով: Նույն օրը նրանցից 2-ի նկատմամբ որպես խափանման միջոց է կիրառվել բացակայելու արգելքը, իսկ 6-ը օրենքով սահմանված կարգով ներկայացվել են ՀՀ հակակոռուպցիոն դատարան՝ վերջիններիս նկատմամբ վարչական հսկողությունը որպես խափանման միջոց կիրառելու միջնորդություններով: Ներկայացված միջնորդություններից 5-ը դատարանի կողմից ամբողջությամբ բավարարվել են, և մեղադրյալների նկատմամբ որպես խափանման միջոցներ են կիրառվել վարչական հսկողությունը: Վերջիններս օրենսդրությամբ սահմանված կարգով ազատ են արձակվել, և նրանց վերաբերյալ փաստաթղթերն ուղարկվել են ՀՀ արդարադատության նախարարության պրոբացիայի ծառայություն: Այս մասին հայտնում է Հակակոռուպցիոն կոմիտեն։
«Դատարանը քննիչի միջնորդություններով մեղադրյալների նկատմամբ սահմանել է նաև արգելքներ՝ առանց վարույթն իրականացնող մարմնի թույլտվության բնակության վայրը չփոխելու, գիշերային ժամերին բնակության վայրը չլքելու, ինչպես նաև որոշակի անձանց հետ (ըստ նախաքննական մարմնի ներկայացման) չհաղորդակցվելու վերաբերյալ:
Այլ կերպ՝ վարույթն իրականացնող մարմինը, առաջնորդվելով հանրային շահով, նպատակ ունենալով ապահովել քրեական վարույթով օբյեկտիվությունն ու անաչառությունը, ընտրել և միջնորդել է մեղադրյալների նկատմամբ ընտրել այնպիսի խափանման միջոցներ, որոնք, ի թիվս այլնի, առավելագույնս կապահովեն նաև վարույթի մասնակիցների ընտրական իրավունքի ազատ իրացումը: Վերոգրյալի հիման վրա Հակակոռուպցիոն կոմիտեն վարույթի մասնակիցներին հորդորում է խստորեն պահպանել ընտրված խափանման միջոցների սահմանափակումները և պայմանները՝ դրսևորելով իրավահպատակ վարքագիծ:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով»,- նշված է հաղորդագրությունում:
