Տղամարդը կազինոյում կորցրել է ավելի քան 43.000 եվրո, դատի է տվել ու շահել գործը

Լիտվայի Կլայպեդայի շրջանային դատարանը անսովոր դեպք է համարել՝ տղամարդը կազինոյում կորցրել է ավելի քան 43.000 եվրո, իսկ հետո դիմել է դատարան՝ պահանջելով իրեն վերադարձնել գումարը և շահել գործը, գրում է Delfi-ն։
Տղամարդը ներառվել է այն մարդկանց ցուցակում, որոնց չպետք է թույլ տալ խաղալ, սակայն նա շարունակել է խաղալ ընկերների օգտահաշիվների միջոցով:
Դատարանի զեկույցում նշվում է, որ հայցվորը խաղադրույքներ է կատարել առցանց կազինոյում և կորցրել 43048,68 եվրո, նա ընկերությունից պահանջել է վերադարձնել իրեն այս գումարը, փոխհատուցել 1940,14 եվրո տոկոսադրույքը, ինչպես նաև դատավարության ծախսերը։ Հայցվորը նշել է, որ իր անունը եղել է այն անձանց ցուցակում, որոնց 10 տարի չպետք է թույլատրվի մոլախաղով զբաղվել։
Սակայն տղամարդը համալրել է երրորդ անձանց հաշիվները եւ կորցրել ավելի քան 43000 եվրո։
Շրջանային դատարանը բավարարել է հայցը, և ընկերությունը պետք է վերադարձնի ողջ գումարը հայցվորին։ Ընկերությունը բողոքարկել է որոշումը։ Շրջանային դատարանի դատավորներից կազմված կոլեգիան մերժել է բողոքը՝ համարելով, որ դատարանի որոշումը հիմնավոր է։
Պարզվել է, որ հայցվորը խաղացել է այլ անձանց օգտահաշիվներից, սակայն գումար է փոխանցել իր անձնական հաշվից։
Պարզվել է, որ ընկերությունը պետք է նախապես ստուգեր, թե ում հաշվից է ստացվում գումարը, արդյոք հաշվի սեփականատիրոջ տվյալները համապատասխանում են պրոֆիլի սեփականատիրոջ տվյալներին, սակայն չի կատարել այդ պարտավորությունը։ Եթե ընկերությունը ստուգեր նման տեղեկատվությունը, ապա ոչ ոք չէր կարողանա օգտվել երրորդ կողմի պրոֆիլներից: Համաձայն գործող օրենքների՝ հեռավար խաղի ժամանակ գումար կարող է ընդունվել միայն այն անձի հաշվից, ով բացել է պրոֆիլը:
Հենց խաղի կազմակերպիչը տեսնի, որ գումարը եկել է այն անձի հաշվից, որը ընդգրկված է այն անձանց ցուցակում, ովքեր չպետք է խաղադրույք կատարեն, խաղը պետք է դադարեցվի։ Շրջանային դատարանի վճիռն ուժի մեջ է մտնում հրապարակման պահից, սակայն երեք ամսվա ընթացքում այն կարող է բողոքարկվել Լիտվայի Գերագույն դատարան։
