Պետական այլ մարմիններում կոչումով ծառայության ստաժը կհաշվարկվի պրոբացիայի ծառայությունում հերթական կոչում շնորհելու համար ծառայության ստաժը հաշվարկելիս. «Փաստ»

«Փաստ» օրաթերթը գրում է.

Արդարադատության նախարարությունն առաջարկում է փոփոխություններ և լրացում կատարել «Պրոբացիայի ծառայության մասին» օրենքում: Գործող օրենսդրական կարգավորումների պայմաններում պրոբացիայի ծառայությունում աշխատանքի ընդունված ծառայողին «արդարադատության ոլորտի հերթական» կոչում կարող է շնորհվել ծառայությունում որոշակի ժամկետով ծառայելու դեպքում: Այս դրույթները վերաբերելի են միայն պրոբացիայի ծառայողներին։ Այնինչ, պրոբացիայի ծառայություն աշխատանքի ընդունված պետական տարբեր մարմինների ծառայողներ, որոնք արդեն իսկ ունեին դասային կոչումներ և կոչումով ծառայության ստաժ, գործող իրավակարգավորումների պայմաններում պաշտոնի նշանակվելիս հայտնվում են ոչ բարենպաստ վիճակում՝ կապված վերջիններիս կոչումներ շնորհելու համար ծառայության ժամկետի հաշվարկի հետ: Բաց է մնում պետական այլ մարմիններում աշխատած անձանց մասով հերթական կոչումի շնորհման համար տվյալ մարմնում ծառայության ժամկետը հաշվակցելու հարցը: Նման պայմաններում խախտվում են նշված անձանց իրավունքները, վերջիններս հայտնվում են անհավասար պայմաններում:

Հաշվի առնելով սա՝ առաջարկվում է «Պրոբացիայի ծառայության մասին» օրենքի 11-րդ հոդվածը լրացնել նոր մասով և սահմանել, որ օրենքով սահմանված կարգով կոչումներ շնորհելիս պրոբացիայի ծառայությունում, պետական այլ մարմիններում շնորհված համապատասխան կոչումով (դասային աստիճանով) ծառայության ժամկետը հաշվի է առնվում։

Բացի այդ, օրենքի 35-րդ հոդված 2-րդ մասի համաձայն՝ «Պրոբացիայի ծառայողների նկատմամբ կարող է կիրառվել նաև արտահերթ կոչում, այդ թվում՝ իրենց զբաղեցրած պաշտոնի համապատասխան կոչումից ավելի բարձր կոչումի շնորհում խրախուսանքի տեսակը, որը պրոբացիայի ծառայողների նկատմամբ ծառայության ամբողջ ընթացքում կարող է կիրառվել մեկ անգամ»։ Սակայն նույն հոդվածի 3-րդ մասով սահմանվել է, որ «սույն հոդվածի 2-րդ մասով նախատեսված խրախուսանքի տեսակը չի կարող կիրառվել պրոբացիայի ծառայության պաշտոնին համապատասխանող՝ սույն օրենքի 9-րդ հոդվածի 1-ին մասով սահմանված առավելագույն կոչում ունեցող պրոբացիայի ծառայողների նկատմամբ»։ Արդյունքում առաջացել է ներքին հակասություն. մի դեպքում՝ օրենքը թույլատրում է պաշտոնին համապատասխան ավելի բարձր կոչում շնորհել, մյուս դեպքում՝ արգելում։ Ուստի և անհրաժեշտություն է առաջացել համապատասխան փոփոխություններ և լրացում կատարել օրենքում։

Այսպիսով՝ նախագծով առաջարկվում է պետական այլ մարմիններում կոչումով ծառայության ստաժը հաշվարկել պրոբացիայի ծառայությունում հերթական կոչում շնորհելու համար ծառայության ստաժը հաշվարկելիս, ինչպես նաև պրոբացիայի ծառայողներին, որպես խրախուսանք, հնարավորություն ընձեռել շնորհելու զբաղեցրած պաշտոնի համապատասխան կոչումից 1 աստիճանով ավելի բարձր կոչում, բացառությամբ՝ արդարադատության գնդապետի կոչումից բարձր կոչումների։
