Արցախցիները կարող են խուսափել անձնագրում «Ադրբեջան» նշումից. ՆԳՆ

Արցախցիները կարող են անձնագրում «Ադրբեջան» նշումից խուսափելու համար դիմել և ծննդավայր դաշտում նշել իրենց ծննդյան վկայականում առկա այլ տվյալ՝ մարզը, շրջանը, քաղաքը, ավանը կամ գյուղը։ Այս մասին ՍիվիլՆեթին հայտնել են ՆԳՆ միգրացիայի և քաղաքացիության ծառայությունից, միևնույն ժամանակ նաև զգուշացրել են, որ դա կարող է խնդիրներ առաջացնել սահմանային անցակետերում:
«ՀՀ գործող օրենսդրությունը ծննդավայրի վերաբերյալ սահմանում է այլընտրանք՝ կառավարության որոշմամբ, համաձայն որի՝ ՀՀ քաղաքացու անձնագրում քաղաքացու անձի մասին գրառվում է ծննդյան վայրը (պետությունը կամ անձի ցանկությամբ մարզը կամ շրջանը կամ քաղաքը կամ ավանը կամ գյուղը՝ ծննդյան վկայականում համապատասխան նշումների առկայության դեպքում), ուստի քաղաքացու դիմումի հիման վրա կարող է նշվել նաև ծննդյան վկայականում առկա այլ տվյալ, սակայն կարող է խնդրահարույց լինել սահմանային անցման կետերում»,- հայտնում են ծառայությունից։
2023-ի Արցախի բռնի տեղահանումից հետո՝ ապրիլի 16-ի դրությամբ, Լեռնային Ղարաբաղից բռնի տեղահանված 8 568 անձ է դիմել ՀՀ քաղաքացիություն ստանալու համար։
Արցախցիների մտահոգությանը, թե ինչու է ՀՀ քաղաքացու իրենց անձնագրում ծննդավայրը նշվում Ադրբեջան, միգրացիայի և քաղաքացիության ծառայությունից արձագանքել են՝ ասելով, որ անձնագրերում ծննդավայրի նշումը կարգավորվում է միջազգային ICAO և ISO 3166 ստանդարտներով, իսկ դրանցից դուրս ցանկացած նշում ՆԳՆ-ի կողմից խնդրահարույց է համարվում սահմանային անցակետերում:
«Մեքենաընթերցվող անձը հաստատող ճամփորդական փաստաթղթերի թողարկման ոլորտը կարգավորվում է ICAO (Քաղաքացիական ավիացիայի միջազգային կազմակերպություն) 9303 ստանդարտով, որում նշվում է, որ ծննդյան վայրը նշման դաշտը կարգավորվում է ISO 3166 ստանդարտով։ Վերջինս, ըստ պետությունների, ամրագրում է այն աշխարհագրական միավորները, որոնց վերաբերյալ նշումն ընդունելի է անձնագրում։
Ըստ այդմ՝ ոլորտի լիազոր մարմնի՝ ՆԳՆ միգրացիայի և քաղաքացիության ծառայության կողմից կատարվող ցանկացած նշում, որը վավերացված չէ միջազգային կարգավորման շրջանակում, խնդրահարույց է սահմանային անցման կետերում։ Տարբեր երկրների սահմանային վերահսկողություն իրականացնող մարմինների կողմից նման ահազանգեր են ստացվել ՆԳՆ միգրացիայի և քաղաքացիության ծառայությունում։ Ծառայության ամենօրյա գործունեության ընթացքում նշված խնդիրները գործընկերային ճանապարհով հնարավորինս կարգավորվում են։ Հարցի իրավաչափ կարգավորման նպատակով անձի նոր փաստաթղթավորման դեպքում ծառայությունը բացառապես առաջնորդվում է միջազգային ստանդարտով»,- ասված է պարզաբանման մեջ։
