Ես ուշադիր և մտահոգությամբ հետևում եմ Անար Մամեդլիի դեմ հարուցված քրեական գործին։ Այս մասին հայտարարել է Եվրոպայի խորհրդի մարդու իրավունքների հանձնակատար Մայքլ Օ'Ֆլահերտին։

«Մամեդլին ձերբակալվել է ուղիղ մեկ տարի առաջ և շարունակում է մնալ կալանքի տակ՝ սպասելով դատավարությանը՝ արտարժույթի մաքսանենգության, հարկերից խուսափելու, անօրինական ձեռնարկատիրական գործունեության և փաստաթղթերի կեղծման մեղադրանքներով։ Ես նաև մտահոգությամբ նշում եմ, որ տասնյակ մարդու իրավունքների պաշտպաններ, լրագրողներ և քաղաքացիական հասարակության ակտիվիստներ ներկայումս բանտարկված են Ադրբեջանում իրենց օրինական գործունեության կամ այլախոհ կամ քննադատական ​​​​կարծիքներ արտահայտելու համար։ Ես կոչ եմ անում Ադրբեջանի իշխանություններին անհապաղ ազատ արձակել Անար Մամեդլիին և մյուս բոլոր մարդու իրավունքների պաշտպաններին, լրագրողներին և քաղաքացիական հասարակության ակտիվիստներին, որոնք բանտարկված են իրենց գործունեության համար, և վերացնել նրանց դեմ քրեական մեղադրանքները և դրանց հետ կապված բոլոր սահմանափակումները, այդ թվում՝ արտասահման մեկնելու արգելքը։

Դատարանի գրեթե մեկ տասնամյակ առաջվա նմանատիպ գործերով նախադեպային իրավունքը բացահայտեց «կառավարության քննադատների, քաղաքացիական հասարակության ակտիվիստների և մարդու իրավունքների պաշտպանների կամայական ձերբակալությունների և կալանավորումների անհանգստացնող օրինաչափություն՝ հակադարձ հետապնդումների և քրեական օրենսդրության չարաշահման միջոցով՝ խախտելով օրենքի գերակայությունը»։ Ես արդեն նշել եմ 2024 թվականի նոյեմբերին Ադրբեջանի նախագահին ուղղված իմ նամակում, որ որպես Եվրոպայի խորհրդի անդամ պետություն, Ադրբեջանը պետք է աշխատի մարդու իրավունքների պաշտպանների, լրագրողների և քաղաքացիական հասարակության ակտիվիստների համար անվտանգ և նպաստավոր միջավայր ստեղծելու ուղղությամբ՝ հիմնված երկխոսության և համագործակցության վրա։

Ես մտահոգված եմ, որ տարբեր սահմանափակող իրավական դրույթները, կարծես թե, դժվարացնում են ոչ կառավարական կազմակերպությունների և անկախ լրատվամիջոցների գործունեությունը և իրենց ազատությունների իրականացումը։ Այս առումով, ես նշում եմ, որ Դատարանը, Իրավունքի միջոցով ժողովրդավարության եվրոպական հանձնաժողովը (Վենետիկի հանձնաժողով) և ՄԱԿ-ի խոշտանգումների դեմ պայքարի կոմիտեն պարզել են, որ Ադրբեջանի օրենսդրությունը չի համապատասխանում քաղաքացիական հասարակության և լրատվամիջոցների կարգավորման միջազգային չափանիշներին։

Ես կոչ եմ անում Ադրբեջանի իշխանություններին ձեռնարկել բոլոր անհրաժեշտ միջոցները՝ ապահովելու համար, որ միավորումների, հավաքների և խոսքի ազատության վերաբերյալ բոլոր օրենքներն ու պրակտիկան, ինչպես նաև երկրում մարդու իրավունքների պաշտպանների, լրագրողների և քաղաքացիական հասարակության ակտիվիստների իրավիճակը համապատասխանեն Եվրոպայի խորհրդի մարդու իրավունքների համապատասխան չափանիշներին, այդ թվում՝ լիովին կատարելով Դատարանի համապատասխան որոշումները։ Ես շարունակելու եմ ուշադիր հետևել իրավիճակին և բարձրացնել այս հարցերը Ադրբեջանի իշխանությունների հետ, այդ թվում՝ երկիր այցելությունների ժամանակ», - նշել է նա։
