ՀՀ վարչական դատարանը (Սևանի նստավայր)՝ նախագահությամբ դատավոր Արկադիկ Մկրտչյանի, ամբողջությամբ բավարարել է ՀՀ ներքին գործերի նախարարության ոստիկանության պարեկային ծառայության՝ 17.06.2024թ. թիվ 8180319202 (Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 124-րդ հոդվածի 13-րդ մասի հատկանիշներով՝ տուգան՝ 5.000 դրամի չափով, հանդիպակաց երթևեկող տրանսպորտային միջոցից 150 մ պակաս հեռավորության վրա հեռահար լույսը մոտակայի չփոխարկելու), թիվ 8180319203 (Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 128-րդ հոդվածի 4-րդ մասի հատկանիշներով՝ տուգանք՝ 10.000 դրամի չափով, տրանսպորտային միջոցը այլ երկրի վարորդական վկայականով վարելու), թիվ 8180319204 (Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքի 124-րդ հոդվածի 31-րդ մասի հատկանիշներով՝ տրանսպորտային միջոցներ վարելու իրավունքից մեկ տարի ժամկետով զրկելու, տրանսպորտային միջոցը կանգնեցնելու մասին ոստիկանության ծառայողի օրենքով սահմանված կարգով տրված հրահանգը դիտավորյալ չկատարելու) որոշումները և վարչական բողոքի վերաբերյալ 16.08.2024 թվականի որոշումն անվավեր ճանաչելու պահանջի մասին ներկայացված հայցադիմումը:

Դատարանը վճռով հաստատել է, որ Ս. Մ.-ի գործողությունները բխել են ծայրահեղ անհրաժեշտությունից ելնելով՝ ՀՀ Տավուշի մարզում տեղացած հորդառատ անձրևների պատճառով առաջացած հեղեղումների հետևանքները կանխելու և վերացնելու, այսինքն` մի այնպիսի վտանգ վերացնելու համար, որը սպառնացել է պետական կամ հասարակական կարգին, (...) քաղաքացիների իրավունքներին ու ազատություններին, կառավարման սահմանված կարգին, (...): Դատարանը նաև ընդգծել է, որ տվյալ պարագայում հասցված վնասը՝ վերը նշված իրավախախտումները, կանխված վնասի համեմատությամբ ավելի նվազ կարևորություն ունեն:
