ՊՆ պաշտոնատար անձինք առանձնապես խոշոր չափերով կաշառք են ստացել․ ՀԿԿ

ՀՀ հակակոռուպցիոն կոմիտեում քննված քրեական վարույթով հիմնավորվել է, որ ՀՀ ՊՆ N զորամասում շինարարական աշխատանքների իրականացման նպատակով ՊՆ-ի և կապալառու ընկերության միջև 2023 թվականի հունիսին կնքվել է պետական գնման պայմանագիր, որի շրջանակում շինարարական աշխատանքները կատարվել են թերի, իսկ որոշ աշխատանքների համար օգտագործվել են նախատեսվածից 3 անգամ ցածր արժեքով անորակ նյութեր: Նման պայմաններում կապալառու ընկերության տնօրենը, խաբեության եղանակով ՊՆ-ից առանձնապես խոշոր չափերով գույք հափշտակելու դիտավորությամբ, իր մտերիմի՝ շինարարական աշխատանքների կատարման նկատմամբ տեխնիկական հսկողություն իրականացնող ընկերության տնօրենի հետ կազմել է ակտեր, որոնցում ներառվել են փաստացի չկատարված աշխատանքների մասին տվյալները, ինչպես նաև դրանցում թաքցվել է ցածրարժեք նյութերով աշխատանքների կատարման փաստը: Արդյունքում՝ ՊՆ-ից խաբեության եղանակով հափշտակվել է 81.176.000 ՀՀ դրամ: 

Այնուհետև, թերի կատարված աշխատանքներն ընդունելու և դրական եզրակացություններ տալու դիմաց, ՊՆ պաշտոնատար անձը կապալառու ընկերության տնօրենից պահանջել է առանձնապես խոշոր չափերով՝ 10.000.000 ՀՀ դրամ կաշառք, որի մի մասը ստացել է:

Նախաքննությամբ հիմնավորվել է նաև, որ 2024 թվականի հուլիսին ՊՆ-ի և նույն կապալառու ընկերության միջև կնքվել է պետական գնման ևս մեկ պայմանագիր, որով նախատեսված շինաշխատանքների կատարման ընթացքում հնարավոր թերություններն անտեսելու և պայմանագրի կատարման արդյունքների վերաբերյալ դրական եզրակացություններ տալու համար ընկերության տնօրենը ընդհանուր 2.100.000 կաշառք է տվել ՊՆ երկու պաշտոնատար անձանց: Ընդ որում՝ գնման նշված մրցույթին մասնակցելու և գնումների անցկացման կարգը խախտելով հաղթող ճանաչվելու համար, վերը նշված երկու ընկերությունների տնօրեններն ապօրինի վարձատրություն են տվել ՊՆ նախկին աշխատակցին: Արդյունքում՝ գնմանը մասնակցության հայտ ներկայացրած մյուս կազմակերպությունների օրինական շահերին պատճառվել է առանձնապես խոշոր չափերի գույքային վնաս:

Բացի այդ, պարզվել է, որ հիշյալ ընկերությունների ներկայացուցիչները 2025 թվականի հունիսին կաշառք են տվել ՊՆ մեկ այլ պաշտոնատար անձի՝ վերջինիս կողմից ցանկալի բովանդակությամբ տեղեկանք ստանալու համար:

Բազմաթիվ դրվագներով կաշառք ստանալու, տալու, պաշտոնեական լիազորությունները չարաշահելու, առանձնապես խոշոր չափերով հափշտակության, ինչպես նաև ՀՀ քրեական օրենսգրքի մի շարք այլ հոդվածներով նախատեսված հանցավոր արարքներ կատարելու համար մեղադրանք է ներկայացվել 7 անձի, այդ թվում՝ ՊՆ պաշտոնատար անձանց և ՍՊ ընկերությունների տնօրեններին: Վերջիններիս նկատմամբ որպես խափանման միջոց է կիրառվել տնային կալանքը, իսկ ՊՆ պաշտոնյաներից մեկի նկատմամբ՝ կալանքը:

Քրեական վարույթով նախաքննությունն ավարտվել է, և վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են ՀՀ հակակոռուպցիոն դատարան:
