Գումարի դիմաց զինվորական ծառայությունը կրճատող և ծառայությունից ազատող օրենքների նախագծերը հակասահմանադրական են: Այս մասին ֆեյսբուքյան էջում գրել է Հայաստանի մարդու իրավունքների նախկին պաշտպան Արման Թաթոյանը: Ստորև ներկայացնում ենք նրա գրառումն ամբողջությամբ.

 «Նախագծերի ընդունման հիմնավորումները ձևական են, բաղկացած են սիրողական մի քանի գնահատականից, արված չէ մասնագիտական որևէ վերլուծություն: Կոպտորեն խախտված է «Նորմատիվ իրավական ակտերի մասին» ՀՀ օրենքը:

Նախագծերը խտրական են և առաջացնելու են սոցիալական մեծ անարդարություն: Ավելի են պառակտելու հասարակությունը, պառակտելու են բանակը, մարդկանց բաժանելու են խմբերի, հասարակությունում առաջ են գալու արհեստական հակասություններ, ինչն արդեն նկատելի է:

Հիմնավորումներում հղում է արված Հայաստանի անվտանգությանը, բայց ընդունվելու դեպքում այս օրենքներն ավելի մեծ վնաս են հասցնելու երկրի անվտանգությանը՝ ոչ միայն Զինված ուժերի մարտունակության ու Զինված ուժերի կազմում արդարության, այլև հասարակության պառակտման տեսանկյունից:

2) Չկան հիմնավորումներ, թե ինչ նպատակով ու սկզբունքներով է որոշվել փոխել պարտադիր զինվորական ծառայության սահմանային տարիքը` 27-ից դարձնելով 37:

Հաշվարկված և գնահատված չէ նախագծերի տնտեսական, սոցիալական ու հոգեբանական ազդեցությունը (27-37 տարեկանների աշխատուժի, նրանց աշխատանքի և կարիերայի, ընտանիքի ու եկամուտների հարցեր, ավելի հասուն տարիքի անձինք կարող են դժվարությամբ համակերպվել բանակային կենցաղին, ինչը կառաջացնի հոգեբանական ճնշումներ և այլն): Էլ չեմ խոսում զինված ուժերի մարտունակության մասին, այն առումով, որ այդ տարիքում «զորակոչիկները» չեն կարող ունենալ նույն հոգեբանական-ֆիզիկական պատրաստվածությունն, ինչ ավելի երիտասարդ տարիքում։

Թերություններն այնքան շատ են, որ ամբողջությամբ են անթույլատրելի դարձնում օրենսդրական նախագծերի ընդունումը:

Երկրի անվտանգությունը կազմալուծող, բանակի դեմ ուղղված այս նախագծերն ինքնին ցույց են տալիս, որ ՔՊ-ն շարժվում է միայն քաղաքական հաշվարկներով, պոպուլիստական առաջնահերթություններով` երկրի անվտանգության նկատմամբ առևտրի հոգեբանությամբ: Ի վերջո, այս լուծումները բերելու են արտագաղթի նոր ալիքի»:
