«Զանգեզուրի պղնձամոլիբդենային կոմբինատ» փակ բաժենտիրական ընկերությունը 4 մլրդ 758 մլն 480 հազար դրամի պահանջով դիմել է դատարան՝ ընդդեմ այս տարեսկզբին գործադուլի մասնակցած և այդ պատճառով աշխատանքից ազատված իր 8 աշխատակիցների։ Այս մասին Factor TV-ի հետ զրույցում ասաց փաստաբան Հրայր Խաչատրյանը։ «Դատալեքս» դատական տեղեկատվական համակարգից ծանոթացանք ԶՊՄԿ-ի կողմից ներկայացված հայցային պահանջին, ըստ որի ընկերությունը պահանջում է նախկին 8 աշխատակիցներից հօգուտ «ԶՊՄԿ» ՓԲ ընկերության համապարտության կարգով բռնագանձել 4,758,480,000 ՀՀ դրամ՝ որպես ընկերությանը պատճառված վնասի գումար. «Բռնագանձել նաև 25 մլն ՀՀ դրամ՝ որպես նախապես վճարված պետական տուրքի գումար, ինչպես նաև փաստաբանի խելամիտ վարձատրության գումար՝ 2,5 մլն ՀՀ դրամի չափով»,- նշվում է հայցի պահանջում։ Ավելին, դատարանի կողմից տրված կատարողական թերթի հիման վրա ՀՀ արդարադատության նախարարության հարկադիր կատարումն ապահովող ծառայության ապօրինի ծագում ունեցող գույքի բռնագանձման և հատուկ նշանակության բաժնում հարուցվել է կատարողական վարույթ, որի շրջանակներում արգելանք է դրվել դատական գործով պատասխանող կողմ հանդիսացող գործարանի 8 նախկին աշխատակիցների սեփականության իրավունքով պատկանող գույքերի վրա։ Թեև «Դատալեքս»-ում չկա ԶՊՄԿ-ի կողմից ներկայացված ամբողջ հայցի բովանդակությունը, սակայն, ըստ ամենայնի, կոմբինատն այդքան է գնահատել գործադուլի հետևանքով չաշխատելու օրերի ընթացքում ԶՊՄԿ-ի կրած վնասը։

Ստեղծված իրավիճակում ծագած մի շարք հարցերի պարզաբանման համար Factor TV-ն կապ հաստատեց նաև ԶՊՄԿ ՓԲԸ-ի հետ։ Լրատվության և հասարակության հետ կապերի բաժնի պետ Արայիկ Մարգարյանի գնահատմամբ՝ աշխատակիցների գործողություններն ապօրինի են եղել, ուստի պետք է իրավական հետևանք ունենային. «Հունվար-փետրվար ամիսներին ԶՊՄԿ-ում ավելի քան 10 օր դադարեցվել էին աշխատանքները՝ մի խումբ մարդկանց ապօրինի գործողությունների արդյունքում։ Գրանցվել են և’ սաբոտաժի դեպքեր, և’ ապօրինի կերպով խոչընդոտվել է իրենց օրինական աշխատանքին վերադառնալու ցանկություն ունեցող հարյուրավոր աշխատակիցների իրավունքը, տեղի են ունեցել այլ՝ ոչ իրավաչափ գործողություններ։ Արդյունքում՝ զգալի տնտեսական վնասներ են կրել թե՛ պետությունը, թե՛ ընկերությունը և նրա հարյուրավոր աշխատակիցներ, բազմաթիվ կապալառուներ և այլ շահագրգիռ կողմեր։ Նման գործողությունները պետք է ունենան իրավական հետևանքներ և դրանց պատասխանատուներին օրենքի շրջանակներում պատասխանատվության կանչելը կոչված է պաշտպանելու ընկերության հազարավոր աշխատակիցների և շահագրգիռ կողմերի շահերը։ Սա իրավական գործընթաց է, որի օրինաչափությունը պետք է որոշի դատարանը, ինչպես ցանկացած իրավական, ժողովրդավարական երկրում»։
