Պաշտոնատար անձի ուղղորդմամբ քաղաքացին սուտ ցուցմունք է տվել. քրեական վարույթի նյութերը դատարանում են

ՀՀ հակակոռուպցիոն կոմիտեում քննված քրեական վարույթով իրականացված նախաքննությամբ պարզվել է, որ ՀՀ ՆԳՆ ոստիկանության ՀՈԳՎ Սպիտակի բաժնի պետի տեղակալը, իր ծառայողական լիազորություններն անցնելով, զբաղեցրած պաշտոնով պայմանավորված ազդեցությունը, ինչպես նաև իր ծանոթ անձին նախկինում ցուցաբերած օգնության հանգամանքն օգտագործելով, համոզել է վերջինիս՝ նրա ինքնությունը գաղտնի պահելու պայմանով, իր կողմից որոշած կեղծ բովանդակությամբ տվյալներ հայտնել քրեական վարույթն իրականացնող մարմնին, հետագայում նաև՝ դատարանին, որի արդյունքում նշված անձը տվել է իրականությանը չհամապատասխանող ցուցմունք։ Այս մասին հայտնում են հակակոռուպցիոն կոմիտեից:
Նշված պաշտոնատար անձի կողմից պաշտոնեական լիազորություններն անցնելու հետևանքով էական վնաս է պատճառվել նաև ՀՀ քաղաքացիների իրավունքներին, այն է՝ պաշտոնյայի ուղղորդմամբ տված սուտ ցուցմունքի հիման վրա դատարանի որոշմամբ քաղաքացիների բնակարաններում և օժանդակ շինություններում կատարվել են խուզարկություններ, ինչի հետևանքով խախտվել է ՀՀ սահմանադրությամբ նախատեսված բնակարանի անձեռնմխելիության իրավունքը։
Պաշտոնեական լիազորություններն անցնելու համար վերը նշված պաշտոնյային մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 441-րդ հոդվածի 1-ին մասով: Նրա նկատմամբ որպես խափանման միջոց է կիրառվել տնային կալանքը:
Քրեական վարույթով նախաքննությունն ավարտվել է: Դատախազի կողմից հաստատվել է մեղադրական եզրակացությունը, և վարույթի նյութերն ուղարկվել են ՀՀ հակակոռուպցիոն դատարան:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
