Փոփոխություններ քաղաքացիական ավիացիայի բնագավառում մատուցվող ծառայությունների պետտուրքերի համակարգում. «Փաստ»

«Փաստ» օրաթերթը գրում է.
Տարածքային կառավարման և ենթակառուցվածքների նախարարության՝ հանրային քննարկման ներկայացված նախագծով առաջարկվում է փոփոխություններ կատարել «Պետական տուրքի մասին» օրենքում։ «Պետական տուրքի մասին» օրենքում դեռևս 2024 թ. մայիսին կատարված լրացումներով քաղաքացիական ավիացիայի բնագավառում մատուցված ծառայությունների համար սահմանվեց պետական տուրք։ Օրենքն ուժի մեջ է մտել 2025 թ. հունվարի 1-ից։
Օրենքի ընդունումից հետո դրա կիրարկումն ապահովելու համար Քաղաքացիական ավիացիայի կոմիտեի կողմից քաղաքացիական ավիացիայի բնագավառի ենթաօրենսդրական իրավական ակտերը մշակելիս, ինչպես նաև հետագայում օրենքի ուժի մեջ մտնելուց հետո գործնական կիրառության ժամանակ վերհանվել են մի շարք խնդիրներ, որոնք պահանջում են լուծումներ։ Մասնավորապես՝ օրենքով նախատեսված են «ծառայություններ», որոնք կոմիտեի կողմից որպես առանձին ծառայություններ չեն մատուցվում, այլ հանդիսանում են մեկ այլ ծառայության բաղադրիչ (օրինակ՝ կոմերցիոն օդաչուի վկայականի քննությունը հանդիսանում է նույն վկայականի տրամադրման գործընթացի մի մասը)։ Հետևաբար առաջարկվել է դրանք հանել օրենքից։
Մյուս կողմից՝ կոմիտեի կողմից մատուցվում են մի շարք ծառայություններ, որոնք նախատեսված չեն օրենքով, սակայն դրանց մատուցման համար կոմիտեի կողմից ծախսվում են մեծ ռեսուրսներ։ Հետևաբար, անհրաժեշտություն է առաջացել դրանք ևս ներառել օրենքում։ Իսկ կոմիտեի կողմից մատուցվող աերոնավիգացիոն սպասարկման ծառայությունները ներառում են օդային երթևեկության կազմակերպման, աերոնավիգացիոն կապի և դիտարկման, աերոնավիգացիոն տեղեկատվության, աերոնավիգացիոն օդերևութաբանական ապահովման ծառայությունները։ Նշված ծառայությունների մատուցման ժամանակ կոմիտեն սերտիֆիկացնում է վերը նշված ծառայություններն առանձին-առանձին, որոնց համար ծախսվող փաստացի աշխատաժամանակը, օգտագործվող ռեսուրսները, ծառայության բնույթը մարդ/ժամ հաշվարկի սկզբունքով էապես տարբերվում են իրարից։ Այդ իսկ պատճառով առաջարկվել է տարանջատել նշված ծառայությունները՝ նախատեսելով տարբեր պետական տուրքեր։
Օրենքով մի շարք ծառայությունների համար սահմանված պետական տուրքը համահունչ չէ այդ ծառայության մատուցման համար ծախսվող փաստացի աշխատաժամանակին և օգտագործվող ռեսուրսներին՝ մարդ/ժամ հաշվարկի սկզբունքով։ Այդ համատեքստում կոմիտեն վերանայել է օրենքով տրված ծառայությունների մատուցման համար փաստացի ծախսվող աշխատաժամանակը և առաջարկել փոփոխել որոշ ծառայությունների համար նախատեսված պետական տուրքի չափը։ Նախագծով առաջարկվել է մի շարք ծառայությունների համար տեղական և օտարերկրյա շահագործողների համար նախատեսել համահավասար մոտեցում, մինչդեռ գործող օրենքով կար տարբերակում, այն էլ՝ էական։
