ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչության սեփականության դեմ ուղղված հանցագործությունների քննության վարչությունում քննվող քրեական վարույթի նախաքննության ընթացքում առերևույթ փաստական տվյալներ են ձեռք բերվել այն մասին, որ ՀՀ արդարադատության նախարարության ՔԿՀ-ների կալանավորներ Վ.Ս.-ն և Մ.Գ.-ն հափշտակություններ կատարելու նպատակով ստեղծել և ղեկավարել են հանցավոր կազմակերպություն՝ դրանում նյութապես շահագրգռելու միջոցով մասնակից դարձնելով մի շարք անձանց:
Մասնավորապես՝ Վ.Ս.-ն «List.am» կայքում տեղադրել է ավտոմեքենաների շուկայականից անհամեմատ ցածր վաճառքի արժեքներ և գնելու ցանկություն հայտնած անձանց հայտնել է՝ իբր նշված ավտոմեքենաները տոկոսով գումարի դիմաց արդեն իսկ գրավադրված են իր հետ նույն շենքում բնակվող անձի մոտ:
Այնուհետև,Վ.Ս.-ն գնորդներին հայտնել է Երևանում գտնվող տարբեր հասցեներ և պարզաբանել, որ զբաղվածության պատճառով անձամբ չի կարող ներկայանալ՝ միաժամանակ տեղեկացնելով, որ գումարը կարող են փոխանցել իր ընտանիքի անդամներից մեկին, որից հետո կարող են տեսնել և զննել ավտոմեքենաները:
Դրանից հետո, Վ.Ս.-ի կողմից վարձակալված օրավարձով բնակարաններում հանցավոր խմբի անդամները ընդունել են գնորդներին՝ նրանցից վերցնելով ընդհանուր 9 մլն 115 հզր ՀՀ դրամ և 34 հզր 300 ԱՄՆ դոլար գումար: Հափշտակված գումարը Վ.Ս.-ի պահանջով փոխանցվել է հանցավոր խմբի անդամներից երկուսին:
Վ.Ս.-ի և Մ.Գ.-ի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 318-րդ հոդվածի 2-րդ մասով (հանցավոր կազմակերպություն ստեղծելը կամ ղեկավարելը) և 255-րդ հոդվածի 3-րդ մասի 1-ին կետով (խարդախությունը) (14 դրվագ) և (2 դրվագ), համապատասխանաբար, հանցավոր խմբի անդամներից 6-ի նկատմամբ՝ 319-րդ հոդվածի 1-ին մասով (hանցավոր կազմակերպությանը մասնակցելը) և 255-րդ հոդվածի 3-րդ մասի 1-ին կետով (խարդախությունը), 1-ի նկատմամբ՝ 319-րդ հոդվածի 1-ին մասով (hանցավոր կազմակերպությանը մասնակցելը) և 255-րդ հոդվածի 3-րդ մասի 1-ին կետով (խարդախությունը) և 238–րդ հոդվածի 3–րդ մասի 1-ին կետով (անչափահասին հանցանքի կատարմանը հակելը կամ դրան մասնակից դարձնելը):
