ՄԻՊ-ը՝ մանկահասակ երեխաների մորը կալանավորելու մասին

ՀՀ ՄԻՊ-ի գրասենյակից հայտնում են․ «2025 թվականի հուլիսի 11-ին Մարդու իրավունքների պաշտպանի աշխատակազմի կողմից սոցիալական մեդիայի և զանգվածային լրատվության միջոցների մշտադիտարկման, ինչպես նաև Պաշտպանի թեժ գծին փաստաբանի կողմից իրականանացրած ահազանգի արդյունքում տեղեկություն է ստացվել առ այն, որ մանկահասակ երեխաների մորը դատարանի որոշմամբ կալանավորում են:
Հարկ ենք համարում հատուկ ընդգծել, որ «Մարդու իրավունքների պաշտպանի մասին» ՀՀ Սահմանադրական օրենքով՝ Պաշտպանն իրավասու չէ միջամտելու դատական վարույթին կամ դատավորների լիազորությունների իրականացմանը կոնկրետ գործով: Այնուամենայնիվ, քաղաքացու և երեխաների իրավունքների ապահովման հետ կապված հարցերը Պաշտպանի անմիջական ուշադրության ներքո են, Պաշտպանի հանձնարարությամբ արդեն իսկ ձեռնարկվել և ձեռնարկվում են համապատասխան քայլեր անձանց իրավունքների երաշխավորման, այդ թվում` երեխայի խնամքի տրամադրման հարցի առնչությամբ:
Հուլիսի 12-ին ՄԻՊ թեժ գծին փաստաբանի կողմից կրկին ահազանգ է ստացվել իրավունքների երաշխավորմանն առնչվող մի քանի հարցերի վերաբերյալ, որոնք Մարդու իրավունքների պաշտպանի միջամտությամբ լուծվել են:
Բացի այդ, մշտադիտարկման արդյունքում արձանագրվել է, որ համացանցում փաստաբանի կողմից տարածվում է երեխայի մասնակցությամբ տեսանյութ: Հարկ է նկատի ունենալ, որ նման զգայուն իրավիճակներում այդպիսի գործողությունների հետևանքով երեխաները հաճախ թիրախավորվում ու առավել խոցելի են դառնում:
Մարդու իրավունքների պաշտպանի՝ որպես «Երեխայի իրավունքների մասին» ՄԱԿ կոնվենցիայի դրույթների կիրառության մշտադիտարկում իրականացնող մարմնի կողմից համացանցում իրականացվող մշտադիտարկումները վկայում են, որ առհասարակ նմանատիպ դեպքերը, երեխաների նկատմամբ ոչ զգայուն մոտեցումները, կրում են շարունակական բնույթ։
Մարդու իրավունքների պաշտպանը խիստ կարևորում է երեխաների իրավունքների, այդ թվում՝ վերջիններիս անձնական տվյալների պաշտպանության իրավունքի խախտման, երեխաներին թիրախավորող վարքագծի ցանկացած դրսևորման բացառումը։ Երեխաների մասնակցությամբ տեղի ունեցող ցանկացած գործընթաց պետք է իրականացվի երեխայի «լավագույնի շահի» ապահովմամբ և «մի՛ վնասիր» սկզբունքով:
Երեխաների անձնական տվյալները հրապարակելիս կամ որևէ այլ եղանակով դրանք այլ անձի մատչելի դարձնելիս` պետք է խստորեն պահպանել անձնական տվյալները երրորդ անձանց հասանելի դարձնելու՝ միջազգային և ներպետական օրենսդրությամբ նախատեսված պահանջները»։
