ՊԵԿ-ը հիշեցնում է անձնական օգտագործման ապրանքների վերաբերյալ օրենսդրական կարգավորումները

Պետական եկամուտների կոմիտեն, հաշվի առնելով ֆիզիկական անձանց կողմից անձնական օգտագործման անվան տակ ձեռնարկատիրական նպատակներով ապրանքների ներմուծման դեպքերը, հարկ է համարում քաղաքացիներին հիշեցնել անձնական օգտագործման ապրանքների վերաբերյալ օրենսդրական կարգավորումները:

Մասնավորապես, Եվրասիական տնտեսական միության մաքսային օրենսգրքի 256-րդ հոդվածի 4-րդ կետի համաձայն՝ Միության մաքսային սահմանով տեղափոխվող ապրանքներն անձնական օգտագործման ապրանքների շարքին դասելն իրականացվում է մաքսային մարմնի կողմից, ելնելով՝

1) Միության մաքսային սահմանով տեղափոխվող ապրանքների մասին ֆիզիկական անձի բանավոր կամ գրավոր դիմումից՝ ուղևորային մաքսային հայտարարագրի օգտագործմամբ

2) ապրանքների բնույթից և քանակից

3) ֆիզիկական անձի՝ Միության մաքսային սահմանը հատելու և (կամ) այդ ֆիզիկական անձի կողմից կամ նրա հասցեով ապրանքները Միության մաքսային սահմանով տեղափոխելու հաճախականությունից:

Նշված կետի 2-րդ և 3-րդ ենթակետերում նշված չափանիշների քանակական բնութագրերը և (կամ) Միության մաքսային սահմանով տեղափոխվող ապրանքներն անձնական օգտագործման ապրանքների շարքին դասելու լրացուցիչ չափանիշները (այդ թվում՝ այն ապրանքների կատեգորիաները, որոնք անկախ քանակից չեն կարող դիտարկվել որպես անձնական օգտագործման) սահմանվում են Եվրասիական տնտեսական միության Հանձնաժողովի կողմից:

Օրենսգրքի 2-րդ հոդվածի 1-ին կետի 46-րդ ենթակետով նաև սահմանված է անձնական օգտագործման ապրանքների բնորոշումը։ Մասնավորապես՝ դրանք այն ապրանքներն են, որոնք նախատեսված են ֆիզիկական անձանց՝ ձեռնարկատիրական գործունեության իրականացման հետ չկապված անձնական, ընտանեկան, տնային և այլ կարիքների համար և Միության մաքսային սահմանով տեղափոխվում են ուղեկցվող կամ չուղեկցվող ուղեբեռով, միջազգային փոստային առաքանիներով կամ այլ եղանակով։

Միաժամանակ՝ մաքսային մարմինների կողմից իրականացվող մաքսային հսկողության գործառնությունների ընթացքում ի հայտ են եկել բազմաթիվ դեպքեր, երբ ֆիզիկական անձինք պետական սահմանի անցման կետերով ներմուծում են ապրանքներ, որոնք իրենց բնույթով, քանակով և հատկապես՝ նույն անձի կողմից դրանց ներմուծման հաճախականությունից ելնելով չեն կարող դիտարկվել որպես անձնական օգտագործման նպատակներով ներմուծվող և, ակնհայտորեն, ներմուծվում են ձեռնարկատիրական նպատակներով։

Ելնելով նշված հանգամանքից՝ ՊԵԿ-ը հորդորում է ձեռնարկատիրական նպատակներով ապրանքներ ներմուծող ֆիզիկական անձանց հաշվառվել համապատասխան մարմիններում ՀՀ օրենսդրությամբ սահմանված կարգով և ապրանքներ ներմուծելիս դրանք հայտարարագրել համապատասխան մաքսային ընթացակարգով։
