ՄԱԿ-ի Գերագույն դատարանը կլիմայի փոփոխությունը մոլորակային մասշտաբի գոյաբանական խնդիր է հռչակել

ՄԱԿ-ի գերագույն դատարանը չորեքշաբթի հրապարակած իր խորհրդատվական եզրակացությունում հայտարարել է, որ երկրները կարող են խախտել միջազգային իրավունքը, եթե չձեռնարկեն միջոցներ մոլորակը կլիմայի փոփոխությունից պաշտպանելու համար, և որ դրա հետևանքներից տուժած երկրները կարող են իրավունք ունենալ փոխհատուցման, հաղորդում է Associated Press գործակալությունը։
Իրավաբանները շտապել են աջակցել Միջազգային դատարանի տեսակետին՝ կլիմայի փոփոխության դեմ պայքարի երկրների պարտավորությունների և այն հետևանքների վերաբերյալ, որոնց կարող են բախվել նրանք, եթե քայլեր չձեռնարկեն։
«Պետության կողմից կլիմայական համակարգը պաշտպանելու համար համապատասխան միջոցներ չձեռնարկելը... կարող է միջազգային մակարդակով անօրինական գործողություն համարվել», - լսումների ժամանակ հայտարարել է գլխավոր դատավոր Յուձի Իվասավան։
Նա կլիմայական ճգնաժամը «կյանքի բոլոր ձևերին և մեր մոլորակի առողջությանը սպառնացող մոլորակային մասշտաբի գոյաբանական խնդիր է որակել»։
Ավելի քան 500 էջանոց ոչ պարտադիր եզրակացությունը դիտվել է որպես միջազգային կլիմայական իրավունքի շրջադարձային կետ։
Հատկանշական է, որ դատարանը որոշել է, որ «մաքուր, առողջ և կայուն միջավայրը» մարդու իրավունքն է։
Դա բացում է դուռը այլ իրավական գործողությունների համար, ներառյալ՝ պետությունների կողմից Արդարադատության միջազգային դատարան դիմելու՝ միմյանց պատասխանատվության ենթարկելու, ինչպես նաև ներպետական իրավական գործողությունների, իրավական գործիքների, մասնավորապես՝ ներդրումային պայմանագրերի համար։ Գործը վարում էր Խաղաղօվկիանոսյան կղզի-պետություն Վանուատուն և աջակցություն էր ստացել ավելի քան 130 երկրների կողմից։ Դատական հայցի կողմերի թվում են ՄԱԿ-ի բոլոր անդամ պետությունները, դրանց թվում՝ խոշոր ջերմոցային գազերի արտանետողներ, ինչպիսին են Միացյալ Նահանգները և Չինաստանը։
