Օրենքի խախտմամբ գրանցվել է քաղաքացու սեփականության իրավունքը Երևանի՝ շուրջ 175 մլն դրամ արժեքով հողամասի նկատմամբ

ՀՀ հակակոռուպցիոն կոմիտեում նախաձեռնված քրեական վարույթով իրականացված նախաքննությամբ պարզվել է, որ 2006 թվականի հոկտեմբերի 30-ից մինչև 2007 թվականի նոյեմբերի 5-ը ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի համապատասխան ստորաբաժանման պետի պաշտոնը զբաղեցրած անձը, նույն ստորաբաժանման 2 այլ պաշտոնատար անձանց հետ նախնական համաձայնությամբ, իշխանական և ծառայողական լիազորություններն օգտագործել է ծառայության շահերին հակառակ և օրենքի խախտմամբ գրանցել քաղաքացու սեփականության իրավունքը Երևան համայնքին պատկանող՝ շուրջ 175 մլն ՀՀ դրամ՝ շուկայականին մոտարկված կադաստրային արժեքով հողամասի նկատմամբ: Այս մասին տեղեկացնում են Հակակոռուպցիոն կոմիտեից:
«Մասնավորապես՝ նախաքննությամբ հիմնավորվել է, որ վերը նշված պաշտոնատար անձը, նախապես տեղյակ լինելով, որ Երևան համայնքին պատկանող՝ Ազատության պողոտա 26/1 հասցեում գտնվող 2963.47 քմ մակերեսով հողամասը «Երևանի Քանաքեռ-Զեյթուն համայնքի ղեկավարի աշխատակազմ» համայնքային կառավարչական հիմնարկին տրամադրված է եղել անհատույց օգտագործման իրավունքով, դիտավորությամբ անտեսելով և խախտելով ՀՀ հողային օրենսգրքի 64-րդ հոդվածի 8-րդ կետի պահանջները, չունենալով որևէ տվյալ, որ հիշյալ հողամասը քաղաքացու կողմից ձեռք է բերվել անհատույց օգտագործման կամ վարձակալության իրավունքով, 2007 թվականի ապրիլի 17-ին նույն ստորաբաժանման երկու այլ պաշտոնյաների հետ համատեղ գրանցել է քաղաքացու սեփականության իրավունքը նշված հողամասի նկատմամբ։
Արդյունքում՝ հիշյալ քաղաքացուն տրամադրվել է սեփականության իրավունքի վկայական, որի հետևանքով էական վնաս է պատճառվել Երևան համայնքի օրինական շահերին, այդ թվում՝ համայնքը զրկվել է շուրջ 175 մլն ՀՀ դրամ՝ շուկայականին մոտարկված կադաստրային արժեքով հողամասի նկատմամբ սեփականության իրավունքից։
Նախկին ՀՀ ԿԱ անշարժ գույքի կադաստրի պետական կոմիտեի ստորաբաժանման պետին մեղադրանք է ներկայացվել 2003 թվականի ապրիլի 18-ին ընդունված ՀՀ քրեական օրենսգրքի 308-րդ հոդվածի 1-ին մասով:
Քրեական վարույթով նախաքննությունն ավարտվել է, և վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են ՀՀ հակակոռուպցիոն դատարան»,- ասվում է հաղորդագրությունում:
