ՀՀ հակակոռուպցիոն կոմիտեում ՀՀ ազգային անվտանգության ծառայությունից ստացված նյութերի հիման վրա նախաձեռնված քրեական վարույթով պարզվել է, որ 2024 թվականից ՀՀ ՊԵԿ համապատասխան ստորաբաժանման պետի տեղակալի պաշտոնը զբաղեցրած անձը ծառայողական պարտականությունները կատարելու ընթացքում ծանոթանալով և մտերիմ հարաբերություններ հաստատելով բրոքերային ծառայություններ մատուցող տնտեսվարողի հետ, վերջինիս հետ եկել է հանցավոր համաձայնության՝ կաշառքի դիմաց 2024-2025 թթ. ընթացքում ՀՀ ներկրված բեռների մաքսային ձևակերպումների ընթացքում նույնանման ապրանքները ցածր արժեքով մաքսազերծելու, հարկերը պակաս հաշվարկելու, ներմուծող տնտեսվարողներին ոչ հասանելի անհրաժեշտ տվյալներ տրամադրելու և հովանավորչության շուրջ: Արդյունքում՝ հիշյալ պաշտոնյան 2024 թվականի նոյեմբերի 23-ին բրոքերային ծառայություններ մատուցող անձից կաշառք է ստացել:

Բացի այդ, նախաքննությամբ պարզվել է, որ ՀՀ ՊԵԿ նույն ստորաբաժանման ավագ մաքսային տեսուչը վերը նշված պաշտոնատար անձի գիտությամբ և հրահանգով 2024-2025 թվականներին ՀՀ ներկրված բեռները կրկին ցածր արժեքով մաքսազերծելու և հովանավորչության համար բրոքերային ծառայություններ մատուցող նույն տնտեսվարողից ստացել է կաշառք:

Կաշառք ստանալու համար ՊԵԿ երկու պաշտոնատար անձանց մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 435-րդ հոդվածի 2-րդ մասի 3-րդ կետով: Նրանց կաշառք տալու համար բրոքերային ծառայություններ մատուցող տնտեսվարողին մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 436-րդ հոդվածի 2-րդ մասի 3-րդ կետով (2 դրվագ):

ՊԵԿ ստորաբաժանման պետի տեղակալի նկատմամբ որպես խափանման միջոց է կիրառվել կալանքը, իսկ տնտեսվարողի նկատմամբ՝ տնային կալանքը և գրավը:

Քրեական վարույթով նախաքննությունն ավարտվել է, և վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են ՀՀ հակակոռուպցիոն դատարան:

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
