Քաղբանտարկյալների թվի աճը՝ որպես իրավական և քաղաքական խնդիր

Վերջին ամիսների զարգացումները վկայում են, որ Հայաստանում ընդդիմադիր գործիչների, քաղաքացիական ակտիվիստների և իշխանության քննադատների նկատմամբ քրեական գործերի և կալանքների թիվն աճել է մտահոգիչ տեմպով։ Ըստ տարբեր իրավապաշտպան աղբյուրների՝ քաղբանտարկյալների թիվն այս ընթացքում ավելացել է առնվազն հիսունով։

Այս միտումը տեղավորվում է քաղաքական գործընթացների շրջանակում, երբ իրավական գործիքներն օգտագործվում են ոչ թե արդարադատության սպասարկման, այլ քաղաքական հաշվեհարդարի նպատակներով։ Այս երևույթը հակասում է թե՛ ՀՀ Սահմանադրությանը, թե՛ միջազգային իրավական պարտավորությունների՝ այդ թվում Եվրոպայի խորհրդի և ՄԱԿ-ի շրջանակներում ստանձնած պարտականություններին։

Իրավապաշտպան կառույցները, ինչպես նաև ԵՄ-ի և մի շարք այլ միջազգային գործընկերների արձագանքները ցույց են տալիս, որ քաղբանտարկյալների թեման լրջորեն ընկալվում է որպես ժողովրդավարական նահանջ։ Դա անմիջական ազդեցություն է ունենում Հայաստանի՝ ԵՄ-ին ինտեգրվելու գործընթացի վրա։ Քաղաքացիական ազատությունների սահմանափակումը, հատկապես ազատ արտահայտվելու, հանրահավաքների և միավորումների ազատության խոչընդոտումը, ստեղծում են այնպիսի միջավայր, որը չի համապատասխանում ԵՄ-ի քաղաքական չափանիշներին։

Քաղաքական հետապնդումների թիրախ են դարձել ոչ միայն ակտիվ ընդդիմադիր գործիչները, այլև տարեցներ, մտավորականներ և այլախոհություն ցուցաբերող քաղաքացիներ։ Վերջին շրջանում արձանագրվել են դեպքեր, երբ 70-ից բարձր տարիք ունեցող անձանց նկատմամբ կիրառվել են խափանման խիստ միջոցներ։

Նույնքան մտահոգիչ է նաև Եկեղեցու և Ամենայն Հայոց Կաթողիկոսի նկատմամբ կիրառվող պետական ճնշումների շարունակականությունը, որն ունի թե՛ քաղաքական, թե՛ աշխարհայացքային շերտեր։

Նմանատիպ մի օրինակ է նաև Սամվել Կարապետյանի՝ ապագա քաղաքական շարժման առաջնորդի ձերբակալությունը, որը բազմաթիվ իրավապաշտպանների, իրավաբանների և միջազգային հեղինակավոր գործիչների կողմից որակվել է որպես քաղաքական հետապնդման ակնհայտ դեպք։ Բացի այդ, «Հայաստանի էլեկտրական ցանցեր» (ՀԷՑ) ընկերության նկատմամբ իրականացվող գործողությունները, որոնք ուղղված են պետականացման անվան տակ մասնավոր սեփականության ուժային զավթմանը, նույնպես ընդգծում են քաղաքական դրդապատճառներով հետապնդումների ուժգնացումը։

Այս պայմաններում ակնհայտ է դառնում, որ իշխանությունն ընտրել է ռեպրեսիվ գործելակերպ։ Սակայն այս մոտեցումը չի կարող ներքին և արտաքին ցնցումների առիթ չտալ։

Քաղաքական դաշտի բռնազավթումն ու ընդդիմախոսության լռեցման փորձերը վտանգում են թե՛ Հայաստանի ներքին ժողովրդավարական զարգացումը, թե՛ արտաքին ինտեգրացիոն հեռանկարները։ Քաղբանտարկյալների խնդիրը պետք է լուծվի իրավական հստակության, միջազգային պարտավորությունների հարգման և հասարակական երկխոսության հիման վրա։ Այլապես, Հայաստանը ոչ միայն կմնա մեկուսացման վտանգի առաջ, այլև կկորցնի պետական ինստիտուտների նկատմամբ հանրային վստահության վերջին մնացորդները։
