Իրավական հակահարված դատարանի դահլիճում

Այսօր հակակոռուպցիոն դատարանում շարունակվեց ՀՀ արդադատության նախկին նախարար Դավիթ Հարությունյանի դեմ ներկայացված ապօրինի ծագում ունեցող գույքի բռնագանձման հայցի դատալսումները:
Դատական նիստը հենց սկզբից վերածվեց իրավական «մարտադաշտի». Դավիթ Հարությունյանը, ում իրավաբանական փորձառությունն անքննելի է ու անառարկելի, դատարանին ներկայացրեց միջնորդություն՝ պահանջելով դատախազների նկատմամբ կիրառել դատական սանկցիա։ Նրա փաստարկները չոր էին, հիմնավորված թվերով։ Ակնհայտ էր, որ սա ոչ թե սովորական դատական գործընթաց է, այլ մարտահրավեր դատաիրավական ողջ համակարգին։
Հարությունյանը մատնանշեց, որ դատախազությունը մի շարք կարևոր հարցերում դատարանին ոչ թե թյուրիմացաբար է սխալ տվյալներ ներկայացրել է, այլ՝ ակնհայտ միտումնավոր է սուտ տեղեկություններ տրամադրել։ Հարությունյանի ներկացրած դատախազության ստերի օրինակները սուր էին. նվազագույն սպառողական զամբյուղի կեղծված հաշվարկներ, իբր գոյություն չունեցող Excel ֆայլեր, հղումներ ՄԻԵԴ-ի՝ երբևէ չարտահայտված դիրքորոշումներին։
Նրա բանաձևումը հստակ էր. «Սա դատավարության հավասարության խախտում է, իսկ դատարանի հանդեպ ստերը՝ անթույլատրելի են»։
Սակայն Դավիթ Հարությունյանն իր խոսքը չսահմանափակեց միայն իր դեմ ներկայացրած հայցով։ Իր ներածական խոսքում նա ընդգծեց. «Իմ միջնորդություններն ու հարցադրումները չեն ծառայում միայն իմ անձնական պաշտպանությանը։ Դրանք ունեն շատ ավելի համակարգային նշանակություն»։ Նա մատնանշեց, որ ապօրինի ծագում ունեցող գործերով ձևավորված արատավոր պրակտիկան պետք է կոտրվի այստեղ ու հիմա, որպեսզի ապագա վարույթները դառնան օրինականության և արդարության տիպար։
Հարությունյանը փաստացի պաշտպանական կողմից վերածվեց դատաիրավական համակարգի քննադատի՝ նպատակ ունենալով բացահայտել դատախազության թերությունները և ցույց տալ, թե ինչպես կարող են դրանք վերածվել քաղաքական հաշվեհարդարի գործիքի։
Դահլիճում բոլոր գտնվողների մոտ տպավորությունն այն էր, որ դատախազությունը թերագնահատել է իր հակառակորդին, իրավական «ճակատամարտը» նոր է սկսվում, և տեղի ունեցողն այլևս անհատական պայքարի շրջանականերից դուրս է։ Սա հստակ ազդանշան էր ամբողջ դատաիրավական համակարգին՝ ուղիղ հարված ստին ու անպատասխանատվությանը։
