ՀՀ հակակոռուպցիոն կոմիտեի կողմից ձեռնարկված օպերատիվ-հետախուզական միջոցառումների արդյունքում նախաձեռնված քրեական վարույթով հիմնավորվել է, որ ՀՀ պետական եկամուտների կոմիտեի հարկ վճարողների ընթացիկ հսկողության հարկային տեսչություն-վարչության գլխավոր հարկային տեսուչը նշանակված հարկային ստուգման ընթացքում անհատ ձեռնարկատիրոջ օգտին ապօրինի գործողության և թողտվության համար կաշառք է ստացել, ինչպես նաև այլ հարկային տեսուչների հետ նախնական համաձայնությամբ՝ խմբի կազմում, իրենց ծառայողական լիազորություններն ու դրանցով պայմանավորված ազդեցությունն օգտագործել են ի վնաս պետության օրինական շահերի:

Մասնավորապես՝ վերը նշված գլխավոր հարկային տեսուչը, պարզելով, որ բետոնի արտադրության ոլորտում ձեռնարկատիրական գործունեություն իրականացնող տնտեսվարողին պատկանող արտադրամասում առանց աշխատանքային պայմանագրի փաստացի աշխատանքային գործունեություն են իրականացրել հարկային մարմնում գրավոր չձևակերպված անձինք, առկա իրավախախտումը չարձանագրելու և հետագայում ապօրինի համագործակցությունը նույն ձևով շարունակելու համար կաշառք է ստացել տնտեսվարողից։

Այնուհետև նույն պաշտոնատար անձը, գործելով խմբի կազմում, ստուգմանը ներգրավված 2 այլ հարկային տեսուչների հետ, կազմել և շրջանառության մեջ են դրել ակնհայտ կեղծ տեղեկություններ պարունակող փաստաթուղթ, որում նշված ԱՁ-ում փաստացի աշխատող առնվազն 6 անձի՝ գրանցված աշխատող հանդիսանալու փաստը չի արձանագրվել: Արդյունքում՝ օրենքով սահմանված կարգով չեն կազմվել ընդհանուր 1․500․000 ՀՀ դրամի չափով վարչական պատասխանատվության ենթարկելու ակտեր, չեն նշանակվել նույնչափ տուգանքներ, որի հետևանքով պետությանը պատճառվել է էական գույքային վնաս՝ չարձանագրված տուգանքի տեսքով։

Կաշառք ստանալու, ծառայողական լիազորությունները չարաշահելու և պաշտոնեական կեղծիք կատարելու համար ՀՀ ՊԵԿ պաշտոնատար անձանց մեղադրանքներ են ներկայացրել ՀՀ քրեական օրենսգրքի 435-րդ հոդվածի 2-րդ մասի 3-րդ կետով, 441-րդ հոդվածի 2-րդ մասի 4-րդ կետով և 445-րդ հոդվածի 2-րդ մասով: Գլխավոր հարկային տեսուչի նկատմամբ որպես խափանման միջոց է կիրառվել կալանքը: Մեղադրանք է ներկայացվել նաև պաշտոնատար անձանց կաշառք տված տնտեսվարողին:

Քրեական  նախաքննությունն ավարտվել է: Վարույթի նյութերը մեղադրական եզրակացությամբ հանձնվել են հսկող դատախազին՝ այն հաստատելու և դատարան ուղարկելու միջնորդությամբ:

Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
