Միջազգային դատարանի որոշման անտեսումը՝ պետական հանցագործություն

Ստոկհոլմի արբիտրաժային դատարանի որոշումը չկատարելը ոչ միայն իրավական խախտում է, այլ նաև սպառնալիք՝ պետական պաշտոնյաների համար։ Հայաստանի կառավարությունը շարունակում է անտեսել միջազգային պարտավորությունները, ինչի հետևանքով արդեն իսկ կարող են առաջանալ քրեական գործեր՝ առնչվող պաշտոնատար անձանց նկատմամբ։ Միջազգային իրավական փաստաթղթերը և վարչապետի գրասենյակի եզրակացությունները հստակ ցույց են տալիս, որ իբր ՀԾԿՀ-ի կողմից, իրականում Փաշինյանի բիրտ միջամտությամբ իրականացվող ժամանակավոր կառավարումը անօրինական է, սակայն դա չի խանգարում իշխանություններին պահպանել այն, ի հեճուկս օրենքի և ողջամտության։

Ավելին, այս անօրինական կառավարման շրջանակում հանրությանը մատուցվում են բացահայտ ապատեղեկատվություններ։ Ներկայիս ղեկավարությունը հայտարարում է միլիարդների խնայողությունների մասին, մինչդեռ իրականում խոսքը գնում է կապալառուներին չվճարելու մասին։ Սխալ ներկայացված թվերը միայն ծածկում են իրականությունը, որտեղ պետական կառույցները չեն կատարում իրենց պարտավորությունները, իսկ հետևանքները դրվում են հասարակության և տնտեսության ուսերին։

Այս ֆոնին աչքի է ընկնում Սամվել Կարապետյանի քայլը․ նա ամեն ամիս սեփական միջոցներից հատկացնում է շուրջ 150 միլիոն դրամ՝ ապահովելու համար աշխատակիցների աշխատավարձերը։ Սա հստակ հակադրություն է իշխանությունների վարքագծին՝ ցույց տալով, որ երբ պետական կառույցները խախտում են օրենքը և հրաժարվում իրական պատասխանատվությունից, գործարարներն են ստիպված իրենց միջոցներով պահպանել աշխատատեղերն ու սոցիալական կայունությունը։

Ստեղծված իրավիճակը ոչ միայն պետական կառավարման ճգնաժամի վկայություն է, այլև խորը հարված Հայաստանի միջազգային հեղինակությանը։ Երբ միջազգային դատարանի վճիռները դառնում են անտեսված թղթի կտոր, երկիրը կորցնում է վստահություն ոչ միայն ներդրողների, այլև գործընկեր պետությունների աչքում։
