Մերձավանում տեղի ունեցած սպանության դեպքի առթիվ նախաձեռնված քրեական վարույթի նախաքննության ընթացքում, ՀՀ ՆԳՆ և ԱԱԾ աշխատակիցների կողմից ձեռնարկված մեծածավալ համալիր օպերատիվ-հետախուզական միջոցառումների արդյունքում, հանցանք կատարելու անմիջականորեն ծագած կասկածի հիմքով ձերբակալվել և նախաքննական մարմին է ներկայացվել մեկ անձ։
Քրեական վարույթի նախաքննության ընթացքում կատարված անհետաձգելի գործողությունների արդյունքում, ձերբակալվածին պատկանող շինությունում հայտնաբերվել են Քրեական օրենսգրքով արգելված՝ արարքին վերջինիս առնչությունը հաստատող բացահայտ հետքեր, այդ թվում՝ հանցագործության կատարման պահին օգտագործված դիմակ, ձեռնոցներ, կոշիկներ, բաճկոն, գիշերային տեսանելիության սարք, որոնք վերջինս փորձել է այրման եղանակով ոչնչացնել։
Քրեական վարույթի նախաքննության ընթացքում կատարվում են բազմաթիվ ապացուցողական և վարութային գործողություններ՝ դեպքի ամբողջական հանգամանքները պարզելու, այդ թվում՝ հանցագործության գործիք հանդիսացող ինքնաձիգը հայտնաբերելու ուղղությամբ։
Քննչական կոմիտեն հավաստիացնում է, որ օպերատիվ-հետախուզական գործունեություն իրականացնող մարմիններն ամբողջությամբ տիրապետում են օպերատիվ իրավիճակին, իսկ նախաքննական մարմինը՝ Քրեական դատավարության օրենսգրքով նախատեսված թույլատրելի գործիքակազմի կիրառմամբ, ձեռնարկելու է անհրաժեշտ միջոցներ՝ քրեական պատասխանատվության անխուսափելիության սկզբունքը կենսագործելու, ինչպես նաև նախաքննության համակողմանիությունն ապահովելու ուղղությամբ։
Հաշվի առնելով քրեական վարույթի հանրային հնչեղությունը՝ Քննչական կոմիտեն քննության արդյունքների վերաբերյալ օրենքով նախատեսված թույլատրելիության սահմաններում պարբերաբար հանդես կգա հաղորդագրությամբ։
Ծանուցում․ հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով՝ դատարանի օրինական ուժի մեջ մտած դատավճռով։
