«Փաստ» օրաթերթը գրում է.

Միջազգային քրեական դատարանի առաջին դատախազ Լուիս Մորենո Օկամպոն հրապարակել է փորձագիտական կարծիք ՄԱԿ-ի՝ Անձանց կամայական կալանավորման հարցերով աշխատանքային խմբի (UN WGAD)՝ 2025 թ. փետրվարի 17-ի թիվ 46/2024 եզրակացության վերաբերյալ: Օկամպոն բացահայտել է շահերի բախման իրական պատկեր, որը լուրջ կասկածի է ենթարկում խմբի եզրակացության անաչառությունը:

Հիշեցնենք, որ 2025 թ. փետրվարի 17-ին վերոհիշյալ՝ Անձանց կամայական կալանավորման հարցերով ՄԱԿ-ի աշխատանքային խումբը (UNWGAD) հրապարակել էր թիվ 46/2024 եզրակացությունը՝ Ռուբեն Վարդանյանի կալանավորման վերաբերյալ:

Եվ այդ խումբը եզրակացրել էր, որ Ռուբեն Վարդանյանի կալանավորումը Ադրբեջանի կողմից կամայական չէր:

Այդքանը բավարար է՝ հասկանալու համար, որ այդ «աշխատանքային խմբում», մեղմ ասած, ինչ-որ բան այն չէ, պարզ ասած՝ ադրբեջանամետ դիրքորոշում ունեն, այլապես նման՝ ակնհայտ սխալ եզրակացության չէին հանգի: Բայց մի բան է մեր ներքին համոզմունքը, և այլ բան, երբ հայտնի փորձագետն է ներկայացնում փաստեր:

Եվ այսպես. Օկամպոն փաստարկված հիմնավորում է շահերի բախման առկայությունը՝ ընդգծելով, որ WGAD-ի ներկայիս նախագահող Գաննա Յուդկիվսկան Equity Law Firm-ի գործընկեր է, որն Ուկրաինայում ներկայացնում է Ադրբեջանի պետական նավթային ընկերությունը՝ SOCAR-ը:

Պարզ ասած, այդ «աշխատանքային խմբի» նախագահողը սնվում է ադրբեջանական նավթադոլարներից: Արժե՞ զարմանալ, որ նման մեկը Ռուբեն Վարդանյանի ապօրինի կալանավորման, իսկ ավելի ճիշտ՝ պատանդառության վերաբերյալ նման «եզրակացություն» էր տվել:

Լուիս Մորենո Օկամպոն իրականացրել է բաց աղբյուրների վրա հիմնված հետաքննություն՝ WGAD-ի ներկայիս նախագահ-զեկուցող, ուկրաինացի իրավաբան տիկին Գաննա Յուդկիվսկայի անաչառության վերաբերյալ։

«Գաննա Յուդկիվսկան պետք է ձեռնպահ մնար Աշխատանքային խմբին ներկայացված Ադրբեջանի դեմ բոլոր գործերից։ Նա ունի շահերի բախում, որը բխում է նրա մասնագիտական աշխատանքից որպես Equity Law Firm-ի ակտիվ գործընկեր: Վերջինս տարիներ շարունակ իրավաբանական ծառայություններ է տրամադրել Ադրբեջանի Հանրապետության պետական նավթային ընկերությանը (SOCAR)։ Սա հաստատում է ուղիղ ֆինանսական կապը նրա և Ադրբեջանի կառավարության միջև, որն էլ տվյալ վարույթում հանդես է գալիս որպես կողմ»,փորձագիտական կարծիքում նշում է Օկամպոն։

Ավելին, Յուդկիվսկայի ամուսինը ադրբեջանական արմատներով ուկրաինացի քաղաքական գործիչ է, որը մեղադրվում է կոռուպցիայի մեջ, ամուր կապեր ունի Ադրբեջանի հետ և հրապարակայնորեն աջակցել է ԼՂ շուրջ Ալիևի դիրքորոշմանը։

Այսինքն, Յուդկիվսկայի մասնակցությունը թիվ 46/2024 կարծիքին խախտում է ՄԱԿ-ի վարքագծի կանոնագիրքը, WGAD-ի աշխատանքային մեթոդները, ՄԱԿ-ի աշխատակազմի կանոնակարգը շահերի բախման վերաբերյալ:

Իսկ դա նշանակում է, որ «աշխատանքային խմբի» վերոնշյալ կարծիքը կամ եզրակացությունը պետք է հայտարարվի առոչինչ, իսկ ՄԱԿ-ը պետք է վերանայի այդ գործը:
