Քաղբանտարկյալներ Հայաստանի ժողովրդավարության ճանապարհին. երկակի ստանդարտների վտանգը

Հայաստանում վերջին ամիսներին քաղաքական դաշտում սրվել է լարվածությունը։ Ընդդիմադիր գործիչների և եկեղեցականների դեմ հարուցված քրեական գործերը հասարակության մեջ առաջացրել են մտահոգություն՝ կապված խոսքի ազատության և ժողովրդավարական սկզբունքների պահպանման հետ։ Հատկապես մեծ արձագանք են ստացել գործարար Սամվել Կարապետյանի և Միքայել Աջապահյան Արքեպիսկոպոսի նկատմամբ իրականացվող քրեական հետապնդումները, որոնք ընդդիմադիր շրջանակներում որակվում են որպես քաղաքական դրդապատճառներով իրականացված քայլեր։
«Հայաստանում ձևավորվել է վտանգավոր իրավիճակ՝ ձայների լռեցմամբ և խոսքի ազատության խախտմամբ։ Սամվել Կարապետյանը և Միքայել Աջապահյան Արքեպիսկոպոսը ԵԽԽՎ բանաձևով հստակ սահմանված չափորոշիչներով քաղաքական բանտարկյալներ են»,- ասում է ԼՀԿ առաջնորդ Էդմոն Մարուքյանը։
Նրա խոսքով՝ 2012թ․ ԵԽԽՎ-ի 1900 բանաձևը հստակ սահմանում է, թե ում կարելի է համարել քաղաքական բանտարկյալ։ Այդ չափանիշներով՝ եթե անձի կալանավորումը տեղի է ունեցել խոսքի, համոզմունքների, հավաքների ազատության խախտմամբ կամ բացառապես քաղաքական շարժառիթներով, եղել է անհամաչափ, խտրական կամ անարդար դատավարության արդյունք, ապա այն արդեն իսկ քաղաքական հետապնդում է։
«Այս փաստերը հստակ ցույց են տալիս, որ Սամվել Կարապետյանի ապօրինի քրեական հետապնդումն ու Միքայել Սրբազանի նկատմամբ հապճեպ դատավճիռը ոչ թե արդարադատության, այլ իշխանական ճնշման հետևանք են։ Նրանք հետապնդվում են իրենց արտահայտած տեսակետի և դիրքորոշման համար, ոչ թե որևէ հանցագործության», – շեշտեց Մարուքյանը։
Քաղաքագետ Սուրեն Սուրենյանցը հավելում է, որ Հայաստանում իշխանությունը շարունակում է փոխարինել քաղաքական մրցակցությունը վարչական ճնշմամբ։
«Դատախազությունն ու ոստիկանությունը վերածվել են իշխանական կամքը սպասարկող գործիքի։ Եթե առաջնորդվենք Փաշինյանի տրամաբանությամբ, ապա պետք է քրեական պատասխանատվության ենթարկվեն նաև նրանք, ովքեր կողմ են քվեարկել Հայաստանի՝ ԵՄ-ին անդամակցելու մասին օրենքին։ Բայց իշխանությունը «ինքնիշխանության» թեման օգտագործում է որպես պատրվակ՝ պահպանելու սեփական իշխանությունը։
Երբ իշխանությունը սկսում է տարբերակել՝ որ կարծիքն է թույլատրելի, իսկ որը՝ ոչ, դա այլևս ժողովրդավարություն չէ․ դա իշխանության մենաշնորհ է»։
Այս հայտարարությունները վկայում են, որ Հայաստանում ժողովրդավարությունը հետընթաց է ապրում, իսկ քաղաքական ընդդիմախոսների ձայները լռեցվում են վարչական ու դատական ճնշումների միջոցով։
