Արտաշատ համայնքի ավագանու նախկին անդամը մեղադրվում է հայտարարագիրը դիտավորությամբ չներկայացնելու մեջ

ՀՀ հակակոռուպցիոն կոմիտեում նախաձեռնված քրեական վարույթով իրականացված նախաքննությամբ պարզվել է, որ ՀՀ Արարատի մարզի Արտաշատ համայնքի ավագանու նախկին անդամն իր պաշտոնավարման դադարեցումից հետո օրենքով սահմանված ժամկետում ՀՀ կոռուպցիայի կանխարգելման հանձնաժողով չի ներկայացրել 2021 թվականի պաշտոնեական պարտականությունները դադարեցնելու օրվա դրությամբ առկա գույքի, եկամուտների, ծախսերի և շահերի հայտարարագիրը։
Մասնավորապես՝ նախաքննությամբ պարզվել է, որ վերը նշված անձը պատշաճ ձևով ծանուցվել է 2021 թվականի պաշտոնեական պարտականությունները դադարեցնելու օրվա դրությամբ առկա գույքի, եկամուտների, ծախսերի և շահերի հայտարարագիրը չներկայացնելու, ինչպես նաև դրանից հետո 30 օրվա ընթացքում համապատասխան հայտարարագիր ներկայացնելու պարտավորության, իսկ հակառակ դեպքում՝ 31-րդ օրը վարչական վարույթ իրականացնելու նպատակով հանձնաժողովին ներկայանալու վերաբերյալ: Հիշյալ անձը, սակայն, այդ ընթացքում չի ներկայացրել հայտարարագիրը և չի ներկայացել հանձնաժողովին:
Դրանից հետո ավագանու նախկին անդամի նկատմամբ կազմվել է վարչական իրավախախտումների վերաբերյալ արձանագրություն, և որոշում է կայացվել նրա նկատմամբ 200․000 ՀՀ դրամի չափով տուգանք նշանակելու մասին:
Պատշաճ ծանուցվելով վարչական տուգանք կիրառված լինելու վերաբերյալ՝ ավագանու նախկին անդամը 30-օրյա ժամկետում դարձյալ հայտարարագիր չի ներկայացրել իրավասու մարմնին՝ ՀՀ կոռուպցիայի կանխարգելման հանձնաժողովին, որի համար վերջինիս մեղադրանք է ներկայացվել ՀՀ քրեական օրենսգրքի 444-րդ հոդվածի 1-ին մասով:
Քրեական վարույթով նախաքննությունն ավարտվել է, և վարույթի նյութերը մեղադրական եզրակացությամբ ուղարկվել են ՀՀ հակակոռուպցիոն դատարան:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
