Խոսքի համար ապօրինի հետապնդման ենթարկված և աննկարագրելի ամոթ առաջացնող հիմնավորմամբ կալանավորված Կոչուբաևը 2025 թ․ նոյեմբերի 1-ին, ժամը 11:00-ին, Հայ-Ռուսական (Սլավոնական) համալսարանում գործող 063 մասնագիտացված խորհրդում պետք է պաշտպանի իր թեկնածուական ատենախոսությունը (https://rau.am/event/avtorefer)։

Կոչուբաևի՝ բացահայտ և աղաղակող ապօրինի ու անհիմն կալանավորումը փաստացի միջամտում է նրա կրթության սահմանադրական իրավունքին (ՀՀ Սահմանադրության 38-րդ հոդված) և ստեղծագործության ազատությանը (ՀՀ Սահմանադրության 43-րդ հոդված՝ «յուրաքանչյուր ոք ունի գրական, գեղարվեստական, գիտական և տեխնիկական ստեղծագործության ազատություն»)։

Ընդ որում, գիտական ստեղծագործության ազատությունը, ըստ՝ հոդվածի կառուցվածքի, սահմանափակման ենթակա չէ։

Պետությունը՝ ՀՀ արդարադատության նախարարությունը (ՔԿՀ-ն որտեղ պահվում է հայցորդը) կամ ՀՀ կրթության, գիտության, մշակույթի և սպորտի նախարարությունը (063 մասնագիտացված խորհուրդը գործում է պետական ակտի հիման վրա) պարտավոր են ապահովել ապօրինի կալանավորված Կոչուբաևի կրթության սահմանադրական իրավունքը և գիտական ստեղծագործության ազատությունը։

Պաշտպանությանը մասնակցելու համար հայցորդը կամ պետք է ներկայացվի մասնագիտացված խորհրդի նիստին, կամ պաշտպանությունը պետք է կազմակերպվի կալանավորվածների պահման վայրում։

Ի դեպ, եղել են դեպքեր, երբ քննությունները կազմակերպվել են ՔԿՀ-ում։

Թերևս՝ սահմանադրական, օրենսդրական, բարոյական և դավանաբանական սահմաններից ձերբազատված քաղաքական և իրավական համակարգերում, որտեղ կալանքի կիրառումը դարձել է խոսքը զսպելու կայուն պրակտիկա, միամտություն է ակնկալել, որ իրավասու մարմինները կապահովեն քաղաքական հետապնդման ենթարկվող հետազոտողի կրթության իրավունքը և գիտական ստեղծագործության ազատությունը։
