Օբյեկտիվ քննության արդյունքում մեղադրյալը կրկին կալանավորվել է

ՀՀ հատուկ քննչական ծառայությունը 2016 թվականի հունվարի 16-ին հաղորդագրություն էր տարածել այն մասին, որ մի խումբ անձանց կողմից նախնական համաձայնությամբ առողջության համար վտանգավոր բռնություն գործադրելով մարդուն առևանգելու, ապօրինի կերպով հրազեն պահելու դեպքի առթիվ հարուցված քրեական գործով ՀՀ քննչական կոմիտեի Շիրակի մարզի Արթ իկի քննչական բաժնում, այնուհետև ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչությունում շուրջ 10 ամիս կատարված նախաքննությունից հետո, 2016 թվականի հունվարի 12-ին լրիվ, օբյեկտիվ և բազմակողմանի քննությունը երաշխավորելու անհրաժեշտությունից ելնելով, հիշյալ քրեական գործը քննության է ուղարկվել ՀՀ հատուկ քննչական ծառայություն: Այս մասին «Արմենպրես»-ին տեղեկացրին ՀՀ հատուկ քննչական ծառայության լրատվական ծառայությունից:

Նախաքննությամբ պարզվել է, որ Ռուբեն Ս.-ն Էդգար Գ.-ի կողմից իրեն պարտք տված գումարը չվերադարձնելու հարցը պարզաբանելու համար վերջինիս առևանգելու նպատակով, 2015 թվականի ապրիլին քաղաքացի Դ. Ս.-ին հորդորել է հեռախոսակապով Էդգար Գ.-ին հրավիրել հանդիպման:

2015 թվականի ապրիլի 16-ին Ռուբեն Ս.-ն, Դ. Ս.-ից տեղեկանալով Էդգար Գ.-ի հետ հանդիպման պայմանավորվածության մասին, Հովհաննես Թ.-ի, Արա Գ.-ի, Գոռ Բ.-ի, ով զինված է եղել ինքնաձիգով և մի խումբ այլ անձանց հետ մեկնել է Սպիտակ քաղաք: Վերջիններս, դարանակալելով պայմանավորված վայրում, սպասել են Էդգար Գ.-ի և Դ. Ս.-ի հանդիպմանը: Երբ Էդգար Գ.-ն մոտեցել է Դ. Ս.-ին, Ռուբեն Ս.-ն և մյուսները մոտեցել են Էդգար Գ.-ին, առողջության համար վտանգավոր բռնություն գործադրելով` բազմաթիվ հարվածներ հասցնելով և ձեռքերը ոլորելով նրան նստեցրել են Արա Գ.-ի վարած ավտոմեքենան և առևանգել:

Դեռևս ՀՀ քննչական կոմիտեի Լոռու մարզային քննչական վարչությունում քննվող հիշյալ քրեական գործի նախաքննության ընթացքում Ռուբեն Ս.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 38-131-րդ հոդվածի 2-րդ մասի 1-ին և 2-րդ կետերով և նրա նկատմամբ որպես խափանման միջոց, դատարանի որոշմամբ, ընտրվել էր կալանավորումը, որը փոխարինվել էր գրավով:

ՀՀ հատուկ քննչական ծառայությունում քննվող հիշյալ քրեական գործի նախաքննության ընթացքում ձեռք են բերվել փաստական տվյալներ այն մասին, որ քրեական գործով մեղադրյալ Ռուբեն Ս.-ն խոչընդոտել է մինչդատական վարույթում գործի քննությանը` քրեական դատավարությանը մասնակցող անձանց վրա անօրինական ազդեցություն գործադրելու ճանապարհով, ուստի համապատասխան հիմնավորմամբ միջնորդություն է ներկայացվել դատարան նրա նկատմամբ որպես խափանման միջոց կիրառված գրավը փոխարինելու և կրկին կալանավորելու վերաբերյալ, ինչը դատարանի կողմից բավարարվել է:

Նշենք, որ հիշյալ քրեական գործով մեղադրանք է առաջադրվել նաև Արա Գ.-ին, Գոռ Բ.-ին և Հովհաննես Թ.-ին, վերջինիս նկատմամբ հայտարարվել է հետախուզում:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
