Մայրը և տատը մեղադրվում են արտաամուսնական կապից հետո ծնված երեխային անզգուշությամբ խեղդամահ անելու համար, Արմավիրի մարզի դատախազությունը 2025 թվականի օգոստոսի 22-ին հայց է ներկայացրել դատարան։
Այս մասին տեղեկություն է հրապարակվել «Դատալեքս» դատական տեղեկատվական համակարգում։
Մ․ Բ․-ն մեղադրվում է այն բանի համար, որ նա, անզգուշությամբ կյանքից զրկել է իր դստեր Լ․ Շ․-ից ծնված երեխային:
Մ․ Բ․-ի դուստրը՝ Լ․ Շ․-ն, 2024 թվականի հունիս ամսին տեղեկացել է, որ արտաամուսնական կապի արդյունքում հղիացել է: 2024 թվականի դեկտեմբերի 28-ին՝ ժամը 16:00-ի սահմաններում, լինելով 34-35 շաբաթական հղիության վիճակում, տանը վաղաժամ սկսված ծննդաբերության հետո Մ․ Բ․-ի օգնությամբ լույս աշխարհ է բերել արական սեռի երեխա:
Ծննդաբերությունից մոտ մեկ ժամ անց, երբ երեխան արտասվել է և ձայներ է հանել, Լ․ Շ․-ն, սենյակում լինելով միայնակ և գտնվելով հոգեճնշող վիճակում, երեխային փաթաթել է ջինսե տաբատով և խեղդամահ անելու եղանակով դիտավորությամբ ապօրինաբար փորձել է կյանքից զրկել, ապա կարծելով, թե երեխան մահացել է. նրան հանձնել է Մ․ Բ․-ին և ասել, որ տանի գցի զուգարանը:
«Մ․ Բ․-ն․, կարծելով, թե երեխան մահացած է, այն պայմաններում, երբ պարտավոր էր և կարող էր նախատեսել երեխայի ողջ լինելու հանգամանքը և իր արարքի վտանգավոր հետևանքի առաջացման հնարավորությունը, տարել և նետել է երեխային հողամասի տարածքում զուգարանը՝ արդյունքում շնչառական անցքերի և ուղիների օտարածին գորշադեղնադարչնավուն կղանքանման չտարբերակվող զանգվածներով փակվելու (օբտուրացիայի) հետևանքով առաջացած մեխանիկական շնչահեղձությամբ անզգուշությամբ կյանքից զրկելով երեխային»,- նշված է մեղադրական եզրակացության մեջ։
2025 թվականի հունվարի 03-ին՝ երեխայի դին հայտնաբերվել է քրեական վարույթի շրջանակներում՝ կատարված դեպքի վայրի զննության արդյունքում:
Մեղադրյալների նկատմամբ որպես խափանման միջոց կիրառվել է բացակայելու արգելքը։
2025 թվականի օգոստոսի 27-ին դատարանը որոշում է կայացրել գործը վարույթ ընդունելու և նախնական դատալսումներ նշանակելու մասին։ Առաջին նիստը կայացել է սեպտեմբերի 8-ին, ևս մեկը՝ հոկտեմբերի 18-ին։ Հաջորդ դատական նիստը նախատեսված է 2026 թվականի մարտի 2-ին, 16։00-ին։
