Նոյեմբերի 21-ին Արմավիրի մարզի առաջին ատյանի ընդհանուր իրավասության դատարանում մակագրվել է քրեական գործ, որով 73-ամյա Մ.Հ.-ը մեղադրվում է անչափահաս թոռների ներկայությամբ անառակաբարո արարքներ կատարելու համար։ Գործը մակագրվել է դատավոր Սերժ Ռուշանյանին։ Այս մասին հայտնում է Iravaban.net-ը՝ հղում անելով Datalex դատական տեղեկատվական համակարգին։
Մեղադրանքի էությունը
Մ.Հ.-ը մեղադրվում է այն բանի համար, որ Արմավիրի մարզի Մեծամոր համայնքի Արմավիր բնակավայրում որդու, հարսի և անչափահաս թոռների հետ համատեղ բնակվելիս բազմիցս կատարել է անառակաբարո արարքներ՝ մերկանալով և ցուցադրելով սեռական օրգանը իր 16 տարին չլրացած թոռների՝ 2012 թվականի հունիսի 4-ին ծնված Մ.Հ.-ի և 2013 թվականի օգոստոսի 10-ին ծնված Ց.Հ.-ի ներկայությամբ։
Վերջին դեպքի հանգամանքները
Համաձայն մեղադրական եզրակացության՝ վերջին դեպքը տեղի է ունեցել 2025 թվականի հոկտեմբեր ամսին։ Մ.Հ.-ը գտնվելով տան բակում՝ մերկացել է՝ հանելով հագին եղած շորերը և ցուցադրելով սեռական օրգանը, ինչից հետո հայհոյանքներ հնչեցնելով դրանք նետել է հարսի՝ Ա.Տ-Հ.-ի ուղղությամբ։
Երբ թոռնուհին՝ Մ.Հ.-ը, դիտողություն է արել պապին, վերջինս շարունակել է հարսի հասցեին հայհոյանքներ հնչեցնել և ասել, որ վերջինն «ուտելու» է իր սեռական օրգանը։
Իրավական գնահատականը
Մ.Հ.-ին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 201-րդ հոդվածի 3-րդ մասի 1-ին կետով՝ վերընթաց ազգականի կողմից անառակաբարո արարք կատարելու համար։
ՀՀ քրեական օրենսգրքի 201-րդ հոդվածի 1-ին մասը սահմանում է պատասխանատվություն 18 տարին լրացած անձի կողմից 16 տարին չլրացած անձի ներկայությամբ մերկանալու կամ սեքսուալ բնույթի այլ գործողություն կատարելու համար։
Նույն հոդվածի 3-րդ մասի 1-ին կետը որակավորող հանգամանք է սահմանում այն դեպքերի համար, երբ արարքը կատարվում է վերընթաց ազգականի կամ այն անձի կողմից, որի վրա դրված է երեխայի դաստիարակության, խնամքի կամ բուժման պարտականություն։
