Նոր մանրամասներ զինծառայողին ինքնասպանության հասցնելու դեպքի առթիվ

ՀՀ քննչական կոմիտեի զինվորական քննչական գլխավոր վարչությունում ավարտվել է պարտադիր ժամկետային զինծառայող Ն.Գ.-ին ինքնասպանության հասցնելու դեպքի առթիվ նախաձեռնված քրեական վարույթի նախաքննությունը:
Նախաքննության ընթացքում պարզվել է, որ պարտադիր ժամկետային զինծառայող Ն.Գ.-ն 2024 թվականի սեպտեմբերի 27-ից հոկտեմբերի 11-ն ընկած ժամանակահատվածում մարտական դիրքում հերթապահության ժամանակ չի պահպանել մեկ այլ զինծառայող Ա.Ղ-ին տրված՝ զինվորական ծառայության պարտականություններից չբխող և բացառապես վերջինիս ազդեցությամբ ու հեղինակությամբ պայմանավորված խոստումը, ինչի հետևանքով Ա.Ղ.-ն նվաստացրել է նրա պատիվն ու արժանապատվությունը:
Վերոգրյալի հետևանքով, 2024 թվականի նոյեմբերի 13-ին Ն.Գ.-ն ինքնասպանություն է գործել՝ կախվելու եղանակով:
Բացի այդ, Ա.Ղ.-ն մարտական հերթապահության ընթացքում թույլ տրված թերացումների համար պարտադիր ժամկետային մի քանի զինծառայողներից պարզաբանումներ է պահանջել՝ նվաստացնելով նրանց պատիվն ու արժանապատվությունը:
Քրեական վարույթի նախաքննության ընթացքում նաև պարզվել է, որ հրաձգային գումարտակի հրամանատար Ա.Ղ.-ն մարտական դիրքում հերթապահության ընթացքում կատարված կարգապահական խախտումների համար բռնություն է գործադրել հինգ զինծառայողի նկատմամբ:
Պարտադիր ժամկետային զինծառայողի նկատմամբ հարուցվել է հանրային քրեական հետապնդում՝ Քրեական օրենսգրքի 522-րդ հոդվածի 2-րդ մասի 2-րդ կետով (զինծառայողին անզգուշությամբ ինքնասպանության հասցնելը) և 524-րդ հոդվածի 2-րդ մասի 3-րդ կետով (զինծառայողին վիրավորանք հասցնելը), իսկ հրաձգային գումարտակի հրամանատարի նկատմամբ՝ 520-րդ հոդվածի 5-րդ մասով (ստորադասի (ենթակայի) նկատմամբ բռնություն գործադրելը կամ բռնություն գործադրելու սպառնալիքը, որն անզգուշությամբ առաջացրել է մարդու մահ) և 520-րդ հոդվածի 3-րդ մասի 2-րդ կետով (ստորադասի (ենթակայի) նկատմամբ բռնություն գործադրելը կամ բռնություն գործադրելու սպառնալիքը) (4 դրվագ):
Քրեական վարույթը մեղադրական եզրակացությամբ ուղարկվել է հսկող դատախազին՝ այն հաստատելու և ըստ էության քննության առնելու համար դատարան ուղարկելու միջնորդությամբ:
Ծանուցում. հանցագործության համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ Քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
