Դատախազը 2025 թվականի դեկտեմբերի 5-ին Տավուշի մարզի առաջին ատյանի ընդհանուր իրավասության դատարան է հանձնել Տավուշի մարզի Զորական բնակավայրում 2025 թվականի սեպտեմբերին անչափահասին առևանգած և նրա նկատմամբ խուլիգանություն կատարած մեղադրյալներ Հ.Ա.-ի, Մ.Բ.-ի, Տ.Ու.-ի, Լ.Ս.-ի և Հ.Գ.-ի վերաբերյալ քրեական վարույթի նյութերը:
Հիշեցնենք, որ Քննչական կոմիտեում քննվող քրեական վարույթի շրջանակում դատախազը 2025 թվականի նոյեմբերի 2-ին հանրային քրեական հետապնդումներ էր հարուցել Հ.Ա.-ի, Մ.Բ.-ի, Տ.Ու.-ի, Լ.Ս.-ի և Հ.Գ.-ի նկատմամբ՝ Քրեական օրենսգրքի 297-րդ հոդվածի 2-րդ մասի 2-րդ կետով (անօգնական վիճակում գտնվողի նկատմամբ խուլիգանություն) և 191-րդ հոդվածի 2-րդ մասի 3-րդ կետով (անչափահասին առևանգելը):
2025 թվականի նոյեմբերի 3-ին և նոյեմբերի 4-ին միջնորդություններ են ներկայացվել Տավուշի մարզի առաջին ատյանի ընդհանուր իրավասության դատարան՝ Հ.Ա.-ի, Մ.Բ.-ի, Տ.Ու.-ի, Լ.Ս.-ի և Հ.Գ.-ի նկատմամբ մեկ ամիս ժամկետով կալանքը որպես խափանման միջոց կիրառելու մասին: Տ.Ու.-ի մասով միջնորդությունն ամբողջությամբ բավարարվել է, Հ.Ա.-ի, Մ.Բ.-ի և Հ.Գ.-ի մասով միջնորդությունները բավարարվել են մասնակի՝ 20 օր ժամկետով, իսկ Լ.Ս.-ի նկատմամբ կիրառվել է տնային կալանք՝ 20 օր ժամկետով:
Նախաքննության ընթացքում միջնորդություններ են ներկայացվել մեղադրյալների նկատմամբ ընտրված կալանք խափանման միջոցը երկարաձգելու վերաբերյալ, որոնք Հ.Գ.-ի, Հ.Ա.-ի, Մ.Բ.-ի և Լ.Ս.-ի մասով ամբողջությամբ մերժվել են (վարույթ իրականացնող մարմնի որոշմամբ նրանց նկատմամբ կիրառվել է բացակայելու արգելք այլընտրանքային խափանման միջոցը), իսկ Տ.Ու.-ի նկատմամբ դատարանի որոշմամբ համակցված կիրառվել է վարչական հսկողություն և բացակայելու արգելք այլընտրանքային խափանման միջոցները:
Տավուշի մարզի առաջին ատյանի ընդհանուր իրավասության դատարանի վերոնշյալ որոշումների դեմ հսկող դատախազի կողմից հատուկ վերանայման բողոքներ են ներկայացվել Վերաքննիչ քրեական դատարան:
